Target group

The seminar should be of interest to those in the legal profession (lawyers, judges), as well as to policy makers, academics, and the private sector. The seminar is also intended for public officials from national, sub-national and local authorities and other public bodies from the EU Member States, candidate countries, European institutions and agencies, dealing with procurement.

Description

This seminar will be mainly devoted to legal issues in European public procurement. The first day of the seminar will concentrate on the current procurement reform. After an overview of the reform proposals on European public procurement, the seminar will concentrate on the state of play of the reform concerning public procurement and the utilities directives. It will examine some specific legal issues such as the optional and mandatory exclusions of economic operators in the context of the reform process. The second day will focus on the recent case law in the field of European public procurement. Special attention will be given to the jurisprudence of the General Court and the Court of Justice of the EU (CJEU). Furthermore, the seminar will cover the relevant case law concerning remedies.

Learning methodology

There will be a series of presentations by officials, legal experts and practitioners, followed by discussions. Participants will be encouraged to exchange views and experiences.

Objectives

This seminar will focus on legal issues in European public procurement including those which arise from the reform of the procurement regime. Considering the growing significance and impact of the case law of the CJEU and the General Court for and on European public procurement policy and legislation, the seminar will update participants on the recent case law in this field.

European Institute of Public Administration (EIPA)

Het Europees instituut voor bestuurskunde (beter bekend als The European Institute of Public Administration - ofwel EIPA) streeft ernaar om de kennis van ambtenaren die zich met de EU bezighouden te vergroten door het ontwikkelen en organiseren van trainingen. Het instituut wil wetenschappelijke kennis en praktische 'know–how' met elkaar verbinden. EIPA bestaat al meer dan 35 jaar.

Het hoofdkantoor van EIPA is gevestigd in Maastricht en heeft dependances in Luxemburg en Barcelona. Gemiddeld nemen 14.000 nationale en Europese ambtenaren per jaar deel aan de trainingen. Daarnaast biedt EIPA ook consultancy, onderzoek en op maat gemaakte programma’s/trainingen aan. Bij EIPA werken circa 120 hoogopgeleide medewerkers.
