De primaire verantwoordelijkheid voor het gezondheidsbeleid en de gezondheidszorg voor de Europese burgers berust bij de lidstaten en het is niet de bedoeling dat de EG het werk van de lidstaten kopieert of nog eens over doet. Maar op bepaalde terreinen kunnen de lidstaten alleen niet doeltreffend optreden en is samenwerking op Gemeenschapsniveau vereist. Dit geldt onder meer voor ernstige bedreigingen voor de gezondheid en grensoverschrijdende en internationale vraagstukken, zoals pandemieën en bioterrorisme, en kwesties die verband houden met het vrije verkeer van goederen, diensten en personen.
Dit vergt een sectoroverschrijdende aanpak. In artikel 152 van het EG-Verdrag is bepaald: 'Bij de bepaling en de uitvoering van elk beleid en elk optreden van de Gemeenschap wordt een hoog niveau van bescherming van de menselijke gezondheid verzekerd.' Met deze strategie wordt een belangrijkere plaats aan gezondheid toegekend in beleidsonderdelen als de Lissabonstrategie voor groei en werkgelegenheid, doordat het verband tussen gezondheid en economische welvaart wordt benadrukt, en de Agenda voor de burger, doordat het recht van personen op zeggenschap over hun eigen gezondheid en gezondheidszorg wordt erkend. De acties in de strategie hebben betrekking op werkzaamheden op gezondheidsgebied in alle sectoren. In het Verdrag wordt gezondheid onder meer genoemd in artikelen over de interne markt, het milieu, de consumentenbescherming, sociale zaken inclusief de veiligheid en gezondheid van werknemers, het ontwikkelingsbeleid en onderzoek.
