I. VOTE

Pursuant to Article 131 of the Rules of Procedure of the European Parliament, since no amendment has been submitted, the President of the European Parliament has declared the Council's position at first reading to be adopted.

The text of the Parliament's Resolution is here annexed. II. ADOPTION OF LEGISLATIVE ACTS FOLLOWING THE EUROPEAN PARLIAMENT'S SECOND READING

Since the European Parliament has approved the Council's position in first reading, the act in question is deemed to have been adopted in accordance with the Council's position in first reading, as provided for in Article 294 7 a) of the TFEU.

After signing by the President of the European Parliament and the President of the Council, the act in question will be published in the Official Journal of the European Union.

Extension of the provisions of Regulation (EC) No 883/2004 and Regulation (EC)

No 987/2009 to nationals of third countries who are not already covered by these provisions solely on the ground of their nationality ***II

European Parliament legislative resolution of 7 October 2010 on the Council position at first reading with a view to the adoption of a Regulation of the European Parliament and of the Council extending Regulation (EC) No 883/2004 and Regulation (EC) No 987/2009 to nationals of third countries who are not already covered by these Regulations solely on the ground of their nationality (11160/4/2010 C7-0208/2010 2007/0152(COD))

(Ordinary legislative procedure: second reading)

The European Parliament, having regard to the Council position at first reading (11160/4/2010 C7-0208/2010), having regard to the Commission proposal to the Council (COM(2007)0439), having regard to Article 63(4) and Article 67 of the EC Treaty, pursuant to which the Council consulted Parliament (C6-0289/2007), having regard to its position of 9 July 2008,

having regard to the Commission Communication to Parliament and the Council entitled `Consequences of the entry into force of the Treaty of Lisbon for ongoing interinstitutional decision-making procedures' (COM(2009)0665),

having regard to Article 294(7) and Article 79(2)(b) of the Treaty on the Functioning of the European Union, having regard to its resolution of 5 May 2010 on the consequences of the entry into force of the Treaty of Lisbon for ongoing interinstitutional decision-making procedures (COM(2009)0665)

`omnibus',

having regard to the opinion of the European Economic and Social Committee of 16 January 2008,

having regard to Rule 72 of its Rules of Procedure, having regard to the recommendation for second reading of the Committee on Employment and Social Affairs (A7-0261/2010),

  • 1. 
    Approves the Council position;
  • 2. 
    Notes that the act is adopted in accordance with the Council position;
  • 3. 
    Instructs its President to sign the act with the President of the Council pursuant to Article 297(1)

of the Treaty on the Functioning of the European Union;

  • 4. 
    Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to arrange for its publication in the Official Journal of the European Union;
  • 5. 
    Instructs its President to forward its position to the Council, the Commission and the national parliaments.
