(2) De Commissie heeft op 12 mei 1995 een aanbeveling over de betalingstermijnen bij handelstransacties(5) vastgesteld.
(3) Het Europees Parlement heeft in zijn resolutie betreffende de aanbeveling van de Commissie over de betalingstermijnen bij handelstransacties(6) deze laatste in overweging gegeven haar aanbeveling in een voorstel voor een richtlijn van de Raad om te zetten en dit zo spoedig mogelijk in te dienen.
(4) Het Economisch en Sociaal Comité heeft op 29 mei 1997 advies uitgebracht over het groenboek van de Commissie: 'De overheidsopdrachten in de Europese Unie: beschouwingen over een toekomstig beleid'(7).
(5) De Commissie heeft op 4 juni 1997 een actieprogramma voor de interne markt bekendgemaakt, waarin wordt onderstreept dat betalingsachterstand een steeds ernstiger wordende hinderpaal vormt voor het welslagen van de interne markt.
(6) De Commissie heeft op 17 juli 1997 een mededeling met de titel 'Verslag over betalingsachterstanden bij handelstransacties'(8) bekendgemaakt, die een samenvatting biedt van de uitkomsten van een beoordeling van de uitwerking van de aanbeveling van de Commissie van 12 mei 1995.

Deze Richtlijn is gebaseerd op EG-Verdrag artikel 95. Artikel 95 maakt onderdeel uit van het hoofdstuk 'Aanpassing van de wetgevingen' van het EG-Verdrag. Het heeft betrekking op instelling en werking van de interne markt.
