(2) De verschillen tussen de wettelijke en bestuursrechtelijke bepalingen van de lidstaten inzake de etikettering van levensmiddelen kunnen het vrije verkeer van deze producten belemmeren en tot ongelijke mededingingsvoorwaarden leiden.
(3) Het is derhalve noodzakelijk deze wetgevingen onderling aan te passen teneinde bij te dragen tot de goede werking van de interne markt.
(4) De onderhavige richtlijn moet ertoe strekken communautaire voorschriften van algemene en horizontale aard op te stellen die van toepassing zijn op alle levensmiddelen die in de handel worden gebracht.
(5) In tegenstelling daarmee moeten de voorschriften van specifieke en verticale aard die uitsluitend betrekking hebben op bepaalde levensmiddelen worden vastgesteld in het kader van de bepalingen die voor deze producten gelden.
(6) Bij iedere vorm van reglementering op het gebied van de etikettering van levensmiddelen dient in de eerste plaats te worden uitgegaan van de noodzaak de consumenten voor te lichten en te beschermen.

Deze Richtlijn is gebaseerd op EG-Verdrag artikel 95. Artikel 95 maakt onderdeel uit van het hoofdstuk 'Aanpassing van de wetgevingen' van het EG-Verdrag. Het heeft betrekking op instelling en werking van de interne markt.
