Ter voorbereiding van de Raad Concurrentievermogen op 5-6 maart 2009 gaat hierbij voor de

delegaties een herzien ontwerp-voortgangsverslag van het voorzitterschap over betere regelgeving,

waarin de resultaten van de besprekingen in de Groep concurrentievermogen en groei van 3 en

9 februari zijn verwerkt.

voor de zitting van de Raad Concurrentievermogen

Eenvoudige en duidelijke regels voor een sterke economie

Inleiding

  • 1. 
    Het voorzitterschap memoreert dat de Raad bij verschillende gelegenheden conclusies heeft aangenomen waarin de cruciale rol wordt benadrukt van de agenda "betere regelgeving" als

onderdeel van de Lissabonstrategie voor groei en werkgelegenheid. Ook de Europese Raad

heeft het belang benadrukt van een effectief regelgevend kader voor de bevordering van

concurrentievermogen en groei met de interne markt als een van de steunpilaren.

  • 2. 
    Naar de mening van het voorzitterschap winnen duidelijke, eenvoudige en consistente regels die bedrijven - niet het minst mkb-bedrijven - beter in staat stellen het potentieel van de

interne markt te benutten en hun concurrentiepositie op de wereldmarkt te verbeteren, bij de

huidige economische terugval steeds meer aan belang. Duidelijke en eenvoudige regels op

EU-niveau die resulteren in een effectief en afdwingbaar regelgevend kader ondersteunen het

doel van de interne markt: het stimuleren van grensoverschrijdende handel en het aantrekken

van buitenlandse investeringen, en versterken daarmee het concurrentievermogen en de

positie van de EU-bedrijven in mondiaal verband. Daarom verwelkomt het voorzitterschap de

derde strategische evaluatie van betere regelgeving van de Commissie, waaruit een blijvende inzet blijkt voor de beginselen van betere regelgeving, die verbetering van de

kwaliteit en doeltreffendheid van EU-wetgeving en EU-beleid beogen.

    Doel van dit verslag is een beeld te geven van de recente vorderingen met betrekking tot betere regelgeving en van de standpunten van het Tsjechische voorzitterschap over de wijze

waarop het beleid Betere Regelgeving in de EU verder uitgebouwd kan worden.

Effectbeoordeling

  • 4. 
    Wegens de problemen die voortvloeien uit de huidige economische crisis dienen de EU en de lidstaten op gecoördineerde wijze zowel actie op korte termijn te ondernemen als

economische hervormingen voor de langere termijn door te voeren. Ter zake dienende en

gerichte regelgevings- en beleidsmaatregelen moeten gebaseerd zijn op kwaliteitsgegevens uit

solide effectbeoordelingen. Het voorzitterschap beschouwt effectbeoordeling als een continu

proces en een integraal onderdeel van het analyse- en besluitvormingsproces. Elk wetgevings-

voorstel moet de toets van het subsidiariteits- en het evenredigheidsbeginsel kunnen door-

staan. Een hoge standaard van effectbeoordeling, zo mogelijk onder opgave van de

gekwantificeerde kosten en baten van de beschikbare opties, maakt het gemakkelijker

besluiten te nemen en definitieve overeenstemming over regelgeving te bereiken.

    Het voorzitterschap juicht daarom toe dat de Commissie zich blijft inzetten voor de verbetering van het systeem van effectbeoordeling. In 2008 werd dit geaccentueerd door de

herziening van de richtsnoeren voor de effectbeoordeling. De herziene tekst voorziet in

verbeterde sturing, bv. inzake subsidiariteit, meer eigen verantwoordelijkheid voor

effectbeoordelingen en betere tijdplanning van voorbereidende werkzaamheden binnen de

Commissie, kwantificering, onder meer van administratieve kosten, en inspanningen ter

verbetering van de kwaliteit en de consistentie van effectbeoordelingsstudies.

    De kwaliteit van de effectbeoordeling hangt af van de kwaliteit van de beschikbare gegevens. Het voorzitterschap benadrukt het belang van gericht en goed voorbereid overleg, zodat

belanghebbenden effectief kunnen reageren, terwijl aandacht moet worden besteed aan een

goede tijdplanning van het hele wetgevingsproces. Het voorzitterschap juicht toe dat de

Commissie haar diensten aanspoort om voor complexe of gevoelige voorstellen de minimum-

termijn voor overleg van 8 weken te overschrijden, zodat alle belanghebbenden op de hoogte

zijn van en kunnen bijdragen aan het overleg. Het onderstreept dat voor de uiteindelijke

effectbeoordeling duidelijke feedback nodig is over de resultaten van het overleg, onder meer

over de wijze waarop die resultaten in de beoordeling zijn meegenomen. Voorts is het

voorzitterschap van mening dat meer opties voor de voortdurende betrokkenheid van

belanghebbenden in de verdere stadia van het voorbereidingsproces inzake effectbeoordeling

in overweging moeten worden genomen. Dat zou helpen om de verwachtingen van de belang-

hebbenden in verband met het definitieve voorstel in toom te houden en de voorliggende

beleidsopties en hun vermoedelijke kosten en baten te toetsen.

  • 7. 
    Het voorzitterschap merkt tevens op dat binnen de geïntegreerde aanpak van effect beoordeling de "mkb-test" specifieke sturing zal bieden, in die zin dat de kosten en baten voor

het mkb routinematig worden getoetst bij het uitwerken van nieuwe initiatieven, de

beleidsmaatregelen in verhouding staan tot hun doel, gemakkelijk te begrijpen zijn en

markttoegang vergemakkelijken, met name voor kleine en micro-ondernemingen. Nieuwe

voorstellen moeten voorts zorgvuldig op hun gevolgen voor de vier vrijheden van de interne

markt worden getoetst, en bezien moet worden of ze voldoen aan het non-discriminatie-

beginsel. Voorts moet de externe dimensie van het interne-marktbeleid terdege worden

beoordeeld als onderdeel van het effect op de mondiale concurrentie. Ten slotte, moet bij de

nieuwe sturing inzake de gevolgen op nationaal en regionaal niveau gelet worden op de

eventuele specifieke gevolgen voor bepaalde lidstaten en regio's.

  • 8. 
    Naast de kwaliteit van de gegevens voor de effectbeoordeling, is ook een duidelijke presentatie van de voornaamste bevindingen en belangrijkste cijfers belangrijk, zodat zij

gemakkelijk en effectief beoordeeld kunnen worden. Herinnerend aan de conclusies van de

Raad van 29 mei 2008 benadrukt het voorzitterschap het belang van beknopte samen vattingen voor de presentatie van gekwantificeerde belangrijke kosten en baten, onder meer

de administratieve kosten voor bedrijven, en is het van mening dat dergelijke samenvattingen

in de regel alle opties moeten bestrijken, en niet alleen de gekozen optie. Grondig

geëvalueerde alternatieven kunnen het besluitvormingsproces in de instellingen sneller doen

verlopen, in gevallen waarin de medewetgevers voor andere dan de aanvankelijk voorgestelde

oplossingen zouden kiezen.

  • 9. 
    Het voorzitterschap onderkent de belangrijke rol van de Dienst effectbeoordelingen (IAB) voor de bevordering van kwalitatief hoogstaande effectbeoordelingsstudies in de Commissie.

Het voorzitterschap moedigt de voorbereidende instanties van de Raad dan ook aan om zich

voor een degelijke evaluatie van ontwerp-voorstellen en de beoordeling van mogelijke

wijzigingen niet alleen te baseren op effectbeoordelingen maar ook op de adviezen van de

IAB. Dat steeds meer de noodzaak wordt gevoeld om de effecten systematischer te

kwantificeren en de administratieve lasten aan te pakken is een uiterst welkome ontwikkeling.

Het voorzitterschap verzoekt de Commissie om na te gaan hoe voor haar effectbeoordelingen

regelmatiger een beroep kan worden gedaan op externe deskundigheid. Voorts is het

voorzitterschap van mening dat bij effectbeoordelingen altijd uitgebreid moet worden

gemotiveerd waarom de aanbevelingen van de IAB niet zijn opgevolgd.

  • 10. 
    Het voorzitterschap juicht toe dat de drie instellingen in juli 2008 zijn begonnen met de

evaluatie van de gemeenschappelijke aanpak van effectbeoordeling, ziet ernaar uit dat die

zo spoedig mogelijk wordt afgerond, en benadrukt dat daarbij praktische en werkbare

oplossingen moeten worden gevonden.

Administratievelastenvermindering

  • 11. 
    Het voorzitterschap verwelkomt de onlangs bekendgemaakte resultaten van de meting die

indicatieve informatie opleveren over de referentiewaarde van bestaande administratieve

lasten voor alle prioritaire gebieden. Gelet op de ambitieuze doelstelling van het actie-

programma en het tijdschema daarbij benadrukt het voorzitterschap dat snelle indiening van

voorstellen essentieel is om in 2012 het streefcijfer van 25% vermindering van de door EU-

wetgeving veroorzaakte administratieve lasten te kunnen halen.

  • 12. 
    Het voorzitterschap verheugt zich dan ook over de aankondiging van het eerste pakket

reductiemaatregelen, dat reeds ondernomen of op stapel staande acties behelst en de bedrijven

naar schatting 30 miljard euro aan besparingen zou kunnen opleveren . Het steunt volledig het voornemen van de Commissie om alle voorstellen voor de reductiedoelstelling van 25%

voor het eind van haar zittingstermijn in te dienen en waardeert het werk dat de Groep op

hoog niveau van onafhankelijke belanghebbenden inzake administratieve lasten heeft verricht

bij het ontwikkelen van concrete aanbevelingen voor maatregelen. Het voorzitterschap is

verheugd over de aankondiging van de Commissie dat het actieprogramma wordt uitgebreid

met 30 wetgevingsbesluiten, zowel aangenomen als nog voor te stellen besluiten .

Wat de lopende dringende acties betreft, zie tabel in Bijlage I voor de stand van zaken in de Raad.

  • 13. 
    Om in de huidige periode van economische crisis het programma geloofwaardig te maken,

moeten de bedrijven ervan overtuigd worden dat het resultaat zal opleveren, nl. dat het

onnodige bestaande lasten zal verminderen en onnodige nieuwe lasten zal helpen voorkomen.

Het voorzitterschap onderstreept dat tastbare vermindering van administratieve lasten alleen

mogelijk is indien men zich zowel op de bestaande als op de in voorbereiding zijnde wet-

geving richt. De mening van het voorzitterschap is dat het intensieve werk dat de afgelopen

maanden is verricht bij het verzamelen van gegevens over bestaande administratieve lasten op

prioritaire gebieden, in principe op alle beleidsgebieden moet worden uitgevoerd. Het

voorzitterschap is van mening dat een dergelijke aanpak tot uiting moet komen in het

aangekondigde Commissievoorstel over bijdragen tot sectorale vermindering.

  • 14. 
    Tegelijk is het voorzitterschap van mening dat het van belang is om in het begin van de

ambtstermijn van de volgende Commissie te beslissen of het actieprogramma ter

vermindering van de administratieve lasten een eenmalig karakter heeft, dan wel moet worden

uitgebouwd tot een permanent programma waarbij de inspanningen voor de voortdurende

vermindering van administratieve lasten in het nieuwe vereenvoudigingsprogramma worden

ingepast.

  • 15. 
    Kwantitatieve gegevens, met inbegrip van een evaluatie van administratieve lasten, bij de

effectbeoordeling van nieuwe voorstellen blijven van essentieel belang voor een duidelijk

inzicht in de potentiële kosten voor de bedrijven. Het voorzitterschap juicht daarom het

voornemen van de Commissie toe om IT-instrumenten te gebruiken bij deze evaluatie en

verzoekt de Commissie ervoor te zorgen dat kwantificering van de administratieve lasten bij

effectbeoordelingen in toepasselijke gevallen de regel wordt.

  • 16. 
    Voorts merkt het voorzitterschap op dat onnodige administratieve lasten niet alleen terug-

gedrongen zullen worden door het afschaffen van informatieverplichtingen, maar ook door

het verbeteren van de wijze waarop informatie wordt verzameld. Het is hoe dan ook van

belang de eenmaligheidsregel nauwgezet toe te passen om te voorkomen dat bedrijven

verplicht worden reeds beschikbare informatie meermaals te verstrekken, dit teneinde buiten-

sporige kosten voor de administraties te voorkomen en met inachtneming van de interne

administratieve kenmerken van de lidstaten.

  • 17. 
    Het voorzitterschap verheugt zich over de samenwerking tussen de Commissie en de lidstaten

bij de uitvoering van de Dienstenrichtlijn. Dit moet ervoor zorgen dat de uitvoering correct

gebeurt, door goldplating (toevoeging van overbodige voorschriften) te voorkomen, de

administratieve lasten te verminderen en te voorzien in vereenvoudiging van administratieve

procedures.

  • 18. 
    Het voorzitterschap merkt op dat tot nu toe 21 lidstaten hun nationale verminderings-

doelstellingen hebben vastgesteld voor administratieve lasten die voortkomen uit nationale

wetgeving, conform de conclusies van de voorjaarsbijeenkomst van de Europese Raad voor

2007, en verzoekt de lidstaten zich verder in te spannen om die plannen uit te voeren. Het

voorzitterschap onderkent de inspanningen van de Commissie om de lidstaten te helpen bij

hun taak een startpakket beschikbaar te maken waarmee de feitelijke administratieve lasten

worden gemeten.

Vereenvoudiging

  • 19. 
    Het voorzitterschap is ingenomen met de successen die de Commissie heeft gepresenteerd in

het Derde voortgangsverslag over de strategie voor de vereenvoudiging van de regel-

geving. Het verwelkomt ook de resultaten van de screening van het acquis voor 81 nieuwe maatregelen die de volgende Commissie zou kunnen overwegen bij een toekomstig

vereenvoudigingsprogramma. Het voorzitterschap onderstreept dat het vereenvoudigings-

programma de regelgeving op een concrete en tastbare manier moet vereenvoudigen en de

lasten voor bedrijven en burgers moet helpen verminderen.

  • 20. 
    Het voorzitterschap beseft dat er voor een groot aantal vereenvoudigingsvoorstellen (zie

tabel in bijlage II) nog steeds geen overeenkomst is in de Raad en het Europees Parlement.

Het voorzitterschap zal speciale aandacht schenken aan die voorstellen.

  • 21. 
    Het voorzitterschap zou het belang willen onderstrepen van het gebruik van informatie

afkomstig uit evaluaties achteraf¸ bv. om de feitelijke gevolgen van goedgekeurde EU-

wetgeving te toetsen aan haar beoogde reikwijdte en effect. Het voorzitterschap verlangt dan

ook dat de effectbeoordelingsstudies van de Commissie centrale voortgangsindicatoren

bevatten voor toekomstige bewaking en toetsing van aangenomen voorstellen en attendeert

erop dat in voorkomend geval een herzieningsclausule in nieuwe wetgeving moet worden

opgenomen. Gegevens afkomstig uit evaluaties achteraf moeten worden gebruikt om sturing

te geven voor toekomstige vereenvoudigingsprocessen en daarvoor prioriteiten vast te stellen.

Toegang tot het recht en sturing inzake wetgeving

  • 22. 
    Wil wetgeving haar gestelde doelen bereiken en effectief zijn in de praktijk, dan moeten

Europese burgers en bedrijven er tijdig een goed inzicht in krijgen. Dit betekent dat zij

eenvoudig en duidelijk moet zijn gesteld en toegankelijk moet zijn. Bijgevolg is het

voorzitterschap van mening dat toegang tot het recht - waaronder begrepen juridische

informatiesystemen die efficiënte en ergonomische zoekinstrumenten voor toegang tot EU-

wetgeving bevatten - er mede voor zorgt dat EU-wetgeving goed functioneert en goed

begrepen wordt. Ook duidelijke en praktische sturing, waarbij de consequenties van

wetgeving in niet-juridische taal worden uitgelegd voor bedrijven en burgers, draagt bij aan

die doelstelling.

Verdere werkzaamheden

  • 23. 
    Met het oog op het standpunt van de Raad over de derde strategische evaluatie van betere

regelgeving en de ontwikkelingen in de agenda voor beter regelgeven, bevestigt het

voorzitterschap zijn voornemen om een pakket ontwerp-Raadsconclusies op te stellen voor

de zitting van de Raad Concurrentievermogen in mei.
