Statement by Spain The Spanish health authorities' main concern is protecting the safety of consumers, including the most vulnerable groups in the population, such as children. The basis for food safety, as laid down at European level in the White Paper on Food Safety, is risk analysis, supported by an independent risk assessment which the European Food Safety Authority (EFSA) is responsible for conducting. The EFSA has recently assessed the results of the study by McCann et al on the effects of some colours and sodium benzoate on children's behaviour and concluded that it provides only limited evidence that the mixtures tested had a small and statistically significant effect on activity and attention in some children selected from the general population and that the clinical significance of the observed effects remains unclear. In addition, since the additives were not tested individually, it is not possible to ascribe the observed effects to any of the individual compounds. Consequently, including warnings on the label would not, in this case, be a risk management measure based on an independent risk assessment, and we do not believe that it would contribute to improving consumer protection; rather, it could cause confusion. We consider that any measure along these lines would have to be adopted by committee procedure with scrutiny, following a technical discussion based on an opinion from EFSA; we are therefore in favour of the Presidency proposal which moves these labelling requirements to the Annex. Spain considers that adopting the Food Improvements Agents Package is a priority and that it will contribute, as a whole, to improving consumer protection. In our view, given the Presidency proposal, there is no reason to vote against its adoption, which is why, in the end, Spain will abstain when this question is voted on. Statement by Germany Germany considers it necessary to set uniform EU-wide limits for coumarin in foodstuffs containing cinnamon, at levels which ensure consumer health protection while being feasible in practice. We therefore welcome the fact that maximum levels for coumarin have now been laid down for certain foodstuffs. In the interest of preventive consumer health protection, Germany would have preferred a lower coumarin limit for traditional and seasonal bakery ware containing cinnamon than the one now provided for but, in a spirit of compromise can nevertheless support the proposed maximum level. Statement by the Council On 28.11.2008 the Council of Ministers of the European Union adopted a Framework Decision on combating certain forms and expressions of racism and xenophobia by means of criminal law. The aim of the Framework Decision is to approximate criminal law provisions and to combat racist and xenophobic offences more effectively by promoting full and effective judicial cooperation between Member States. The Framework Decision deals with such crimes as incitement to hatred and violence and publicly condoning, denying or grossly trivializing crimes of genocide, crimes against humanity and war crimes. The Framework Decision is limited to crimes committed on the grounds of race, colour, religion, descent and national or ethnic origin. It does not cover crimes committed on other grounds for example by totalitarian regimes. However, the Council deplores all of these crimes. The Council invites the Commission to examine and to report to the Council within two years after the entry into force of the Framework Decision, whether an additional instrument is needed, to cover publicly condoning, denying or grossly trivializing crimes of genocide, crimes against humanity and war crimes directed against a group of persons defined by reference to criteria other than race, colour, religion, descent or national or ethnic origin, such as social status or political convictions. The Berlin declaration adopted on 25 March 2007 stated that "European integration shows that we have learnt the painful lessons of a history marked by bloody conflict." In that light, the Commission will organize a public European hearing on crimes of genocide, crimes against humanity and war crimes committed by totalitarian regimes as well as those who publicly condone, deny, grossly distort or trivialize them, and emphasizes the need for appropriate redress of injustice and if appropriate submit a proposal for a Framework Decision on these crimes.

Statement by the Commission The Commission congratulates the Council on making every effort to reach agreement on such an important subject. It was time for the European Union to adopt a firm stand against racism and xenophobia. However, the Commission considers that Article 7(2) might be interpreted as allowing national law to prevail over Union law. In this connection, the Commission draws attention to the primacy of Union law. Statement by Germany Germany wishes to declare the following concerning its interpretation of the term "public order" as contained in Article 1 paragraph 2 of the Framework Decision on combating certain forms and expressions of racism and xenophobia by means of criminal law, having had the opportunity to share its views with the Legal Service of the Council: Pursuant to recital 6, this Framework Decision is limited to combating particularly serious forms of racism and xenophobia by means of criminal law. Accordingly, Article 1 paragraph 2 of the Framework Decision permits the Member States to choose to punish only such conduct that is carried out in a manner likely to exceed a certain threshold of significance. The legal systems of the Member States contain different concepts and approaches for describing such a threshold. In a number of Member States, the decisive factor is whether individual legal interests have been affected to a particularly severe degree by the conduct described in Article 1 paragraph 1 of the Framework Decision. In those Member States, such conduct may be punished if it is threatening, abusive or insulting to individuals or groups of individuals. In other Member States, the conduct may be punished if certain collective legal interests have been harmed. In these Member States, such conduct may be punished if the conduct described in Article 1 paragraph 1 of the Framework Decision is carried out in a manner likely to disturb "public order" or, in terms of some legislations, "public peace". The Framework Decision leaves room for both concepts in Article 1 paragraph 2 and must be understood so as to allow Member States to maintain their national traditions and approaches in this respect. The reference in recital no. 6 to the fact that the cultural and legal traditions of the Member States are, to some extent, different, and that, particularly in this field, full harmonisation of criminal laws is currently not possible supports that interpretation. Germany therefore assumes that the term "public order" as employed in Article 1 paragraph 2 of the Framework Decision constitutes an expression of the required threshold, which may be further refined in various manners by the Member States when implementing the Framework Decision. Germany assumes in particular that, for the purposes of implementation, the term "öffentliche Friede" as used in the relevant corresponding provisions of German criminal law is covered by the term "public order" as employed in Article 1 paragraph 2 of the Framework Decision.

Statement by the Netherlands The Netherlands wishes to express that it already complies with the obligation of criminalization pursuant to the Articles 1 and 2 of the Framework Decision. Articles 137c, 137d and 137e of the Dutch Criminal Code give a broad criminalization of inciting to hate or violence, of insulting or discriminating because of amongst others race and religion. The term "race" includes also the characteristics skin colour, origin and national or ethnic decent. Under the scope of these Articles also fall condoning, denying or grossly trivialising of the international crimes, referred to in Article 1 subparagraphs c and d, as far as such a conduct incites to hate or violence, insults or discriminates because of race or religion.

Statement by Latvia regarding the crimes of the Totalitarian Communist regime in addition to the statement by the Council Latvia welcomes the adoption of the Framework Decision which constitutes a significant step in fighting the racism and xenophobia in the EU, as well as the Statement adopted by the Council, and considers that further discussions and evaluations are necessary in this field in order to obtain a complete solution to this question. The Framework Decision provides for the criminal liability throughout the EU inter alia for the public condoning, denying or gross trivialising of the crimes committed by the Nazi regime. The scope of application is limited only to the crimes committed by the Nazi regime, but does not cover the crimes committed by the Totalitarian Communist regime, although, while having particular social groups as the main target, these crimes were also committed on the grounds of the ethnic and the national origin, which constitutes an integral part of the content of Racism as defined by the UN Convention on the Elimination of All Forms of Racial Discrimination adopted in 1966. Any violence or threat has to be condemned irrespectively of what was the curtain of the objectives or the ideology these crimes were committed for. People of the EU have experienced the crimes against humanity from the both totalitarian regimes and they both demanded enormous human costs. Therefore Latvia considers that it is necessary that EU applies similar criteria to the crimes committed by both totalitarian regimes and provide for an equal treatment regarding the public condoning, denying or gross trivialising of these crimes. The fact that there are always some people in the society justifying or denying the crimes committed by the Nazis or the Totalitarian Communists not only endangers the basic values of the democracy, but also insults personally the victims and their families, who suffered both these regimes. Preservation of historic memory, assessment of the crimes of totalitarian regimes and their ideologies as well as respect for the victims and freedom fighters is very important for historical justice and for the prevention of the crimes against humanity in the future. Accordingly a similar approach has to be made and all necessary actions have to be done at EU level in order to prevent the revival of any of totalitarian regimes, including Totalitarian Communist regime. Without exploration and recognition of these crimes at the international level, one cannot talk about the irreversibility of these crimes and the reconciliation. The EU has to have a common understanding and similar criteria when treating these crimes. This understanding and treatment has to be based on the criteria, that the human life is the highest value. The motivation or the ideology behind the crime cannot be brought to the forefront. In this respect Latvia appreciates the invitation by Council to the European Commission to examine within two years after the entry into force of the Framework Decision, whether an additional instrument is needed. Latvia considers that the adoption of such an instrument in the future would provide for an application of similar criteria towards these crimes and put on equal footing their victims all around the EU, as well as eliminate the denial and the distortion of the historical truth. At the same time it is essential to promote a common understanding of all these questions at EU level to all the EU Member States. Therefore the document, which was delivered during the 1

European hearing on "Crimes Committed by totalitarian regimes" in Brussels on 8 April 2008 and which was supported by the majority
of the participants, should become as an inspiration for the future actions at the EU level.

Statement by Hungary Hungary wishes to declare the following concerning its interpretation of the term "public order" as contained in Article 1 paragraph 2 of the Framework Decision on combating certain forms and expressions of racism and xenophobia by means of criminal law. According to the settled case law of the Constitutional Court of the Republic of Hungary, the only way for the freedom of expression to be restricted by means of criminal law is if the conduct endangers the rights of identified persons in a direct and obvious way and the conduct is likely to disturb public peace at the same time. In order to support this narrow interpretation, in Hungary the term "public order" as contained in Article 1 paragraph 2 of the Framework Decision is covered by the term "public peace". Statement by France under Article 1(4) of the Framework Decision France declares, in accordance with Article 1(4), that it will make punishable the act of denying or grossly trivialising the crimes referred to in paragraph 1(c) and/or (d) only if the crimes referred to in these paragraphs have been established by a final decision of an international court. Statement by Poland with regard to grossly distorting crimes of genocide, crimes against humanity and war crimes committed for racist and xenophobic reasons Poland emphasises that public gross distortion of genocide, crimes against humanity and war crimes committed for racist and xenophobic reasons constitutes a serious threat to the values protected under this Framework Decision and is comparable to the threats resulting from public condoning, denial or trivialisation of such crimes. Poland understands that, for the sake of precision typical for the nature of criminal law, conduct of public gross distortion was not included in the provisions of the Framework Decision. However, this issue was reflected in the declaration of the Council. Consequently, Poland wants to emphasise that grossly distorting the facts consisting in shifting the responsibility for crimes committed for racist and xenophobic reasons set forth in the Framework Decision from the actual perpetrators thereof, deserves condemnation and adequate reaction from the Member States. One of the examples of such actions is a use of a manifestly false term: "Polish concentration camps." Statements by the Council re plaice and flounder: Scientific advice by STECF and ICES states that stock status of plaice and flounder in the Baltic is unknown. The only information available for this stock is landing statistics. The available data are insufficient for assessing the current stock size and exploitation. Management advice is therefore not available. Data basis for the scientific advice provided by STECF and ICES derives from National laboratories in respective Member States. Member States concerned will develop and implement a scientific program that will ensure sufficient availability of data facilitating the assessment of stock status and provision of recommendations for management measures from 2009 onwards.

Statement by the Commission re Salmon in Subdivisions 22-31: In view of possible transitional difficulties that coastal communities of certain Member States may face by the introduction of the driftnet ban in the Baltic Salmon fishery, the Commission recommends to explore measures offered by the European Fisheries Fund which may serve to address these problems. The Commission encourages efforts by the scientific community, in close cooperation with the concerned fishing industry, aimed at developing a replacement gear that would assure that the traditional salmon fishery is maintained within the framework of respective management measures. re fishing effort for Eastern Baltic cod : As regards fishing effort in the Eastern Baltic the reduction of the 10% is in line with the multi-annual plan. The Commission considers that this fishing effort will allow every Member State to catch its quota. The Commission, in close cooperation with Member States concerned, will follow the development of quota and effort use during 2009 in order to assess if overall effort allocation for this year is sufficient to use the allocated quota and if necessary to address any problems arising from this assessment. re pelagic species : The Commission intends to develop a long-term management framework for pelagic species in the Baltic Sea as part of its work programme in 2009. Statement by Estonia and Finland re Salmon in Subdivision 32 : Salmon in the Gulf of Finland (Subdivision 32) consists of only a few small wild populations together with a number of mixed/reared stocks. The large majority of the total Gulf of Finland salmon stock consists of reared salmon that are released for fisheries purposes. Condition of the wild stocks is poor and the status of the populations is considered to be unsafe. Scientific advice by STECF and ICES recommend that there should be no catch of wild Estonian salmon in 2009 in the Gulf of Finland and fisheries should only be permitted at sites where there is no chance of taking wild salmon from the Gulf of Finland stocks along with reared salmon. Fishing in rivers and river mouths supporting wild stocks should be prevented. Estonia and Finland will take suitable measures under their sovereignty in line with the specific recommendations by ICES and STECF to support recovery of the wild Salmon stocks in the Gulf of Finland.

Statement by the Commission on future reductions in fishing effort The Commission considers that it is important that the fishing effort allocated to the Community fleet fishing for deep sea species be aligned with the catch limits for deep sea stocks for 2009 and 2010. For this purpose and in order to comply with NEAFC 's agreement agreed in 2007, the Commission intends to include, in its Proposal for the Council Regulation establishing the fishing opportunities for 2009 other than those for the Baltic Sea, Black Sea and deep sea species, a reduction by 10% of the current fishing effort levels, measured in kW-days, for vessels holding deep-sea permits. Moreover, with respect to 2010 and in view of providing for a coherent system for long-term management of deep sea fisheries, the Commission foresees to prepare, during the course of 2009, a proposal for the revision of Council Regulation (EC) No 2347/2002 establishing specific access requirements and associated conditions applicable to fishing for deep-sea stocks (OJ L 351, 28.12.2002, p. 6), including new effort limitations for deep-sea vessels. Statement by the Commission, the Council and the European Parliament The REACH Regulation requires ECHA to establish and maintain database(s) with the information on all registered substances, the classification and labelling inventory and the harmonised classification and labelling list. The three institutions note that ECHA, on the basis of substantive input from Member States and the Commission, will, as soon as possible, make available over the internet the chemical names corresponding to the International Chemical Identifications in Tables 3.1 and 3.2 of Annex VI in Community languages. Council and Commission Declaration on certain conditions for European Investment Bank financing operations in the Central Asian countries The Council and the Commission agree for the European Investment Bank (the "EIB") and the Commission to observe the following principles when granting and approving EIB financing operations covered by Community guarantee according to Council Decision 2006/1016/EC
Asian Countries: EIB financing in Central Bank Asia should be carried out in close cooperation with the European Bank for Reconstruction and Development (EBRD), in particular according to the terms set out in the tripartite Memorandum of Understanding signed on 15 December 2006 by the Commission, the EIB and the EBRD, in respect of cooperation in Eastern Europe and the Southern Caucasus, in Russia and in Central Asia, as amended or updated from time to time. Given that the external financial situation of Kyrgyzstan and Tajikistan is still fragile, these two countries should under the current situation only contract additional debt on concessional terms. EIB financing to Kyrgyzstan and Tajikistan should therefore only be provided in the context of financing packages comprising a substantial grant element until such time as the Commission, based on a review of the external financial situation of one or both of the two countries, considers that the situation in the country/countries under review has improved to such an extent that it should be possible for the EIB to grant stand-alone financing under Community guarantee. There is an acknowledged need for EIB lending in Central Asia to focus on energy supply and energy transport projects which also serve EU energy interests. Statement by Portugal The Portuguese delegation states that it is only due to the importance of the subject in question and the need for the Council to adopt an agreed position on the matter that it is not opposing the adoption of these conclusions. Nevertheless, Portugal would like to emphasise that these Council conclusions, in an area which it regards as being of strategic importance and forming part of the priority interests of the European Union, fall short of the response which might be expected from this institution. Stressing the importance of all the European languages and their essential equality, whether it be in their use or their translation, we cannot refrain from insisting on their functional diversity in the actual world context. For this reason, Portugal also considers that these conclusions do not match up to the ambition expressed in the Commission Communication nor to the various resolutions adopted by the European Parliament on this subject and do not attach sufficient value to the enormous cultural, political and economic potential that derives from our sharing of languages with other regions of the world. Nor do they give sufficient weight to the strategic nature the European languages, particularly as official languages that we share with developing countries and around which there are sometimes vast organisations or networks that are essential to the construction of solutions for the reorganisation of the world made necessary and possible by the financial crisis and the prospects opened up by the new democratic leadership in America. Statement by the Commission Following the declaration made by the European Community in accordance with Article II(2) of Protocol 1 to the Lugano Convention, the Commission recalls that it did not propose such a declaration. This declaration has the effect of breaching the parallelism between the Lugano Convention and the parallel Community instrument Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, while the principal objective of the new Lugano Convention was to reinstall such parallelism. As a result, for the Commission this declaration is without prejudice to the ongoing revision of the rules on third party proceedings/notices in the context of Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. Statement by Cyprus Cyprus welcomes the conclusion of the wine agreement between the European Community and Australia. While recognising the importance of such an agreement, the omission of certain traditional expressions from Annex III remains a concern and one which the Cypriot side is confident the Commission will address at the first meeting of the Joint Committee following the signing of the agreement. In the light of the aforementioned, Cyprus understands the relevant negotiators' side letters as being legally binding in this respect. Consequently, Cyprus withdraws its reservation on the issue.

Statement by Hungary Hungary supports the conclusion of the Agreement between the European Community and Australia on trade in wine. Hungary considers that the Agreement represents progress in protecting European Union Member States' geographical designations. Annex II to the Agreement contains sufficient indication of geographical designations and the areas they cover, in compliance with the conditions laid down by national and Community law and administrative provisions. In Annex II to the Agreement, seven communes in Slovakia are listed under the geographical name of "Tokaj". However, this fact cannot be a justification for Slovakia to state, with reference to the geographical area that can be connected with the "Tokaj" geographical designation, that Hungary has recognised the communes listed as being part of the Tokaj wine-growing region. Statement by Portugal Port Phillip Portugal considers that the new EC/Australia wine agreement is globally positive. Portugal welcomes also the phasing out by Australia of the name "Port". Nevertheless, due to the unsatisfactory solution concerning the Australian GI "Port Phillip", Portugal will abstain voting for this Agreement. Portugal considers that the use of Australian geographical indication "Port Phillip" must not, in any way, take advantage of the prestigious and distinctive power of the appellation of origin "Port", damage its reputation or prestige or contribute to its dilution, mislead the consumer as to the origin, characteristics or nature of the product or constitute unfair competition. According to the provisions of paragraph 3 of article 23 and paragraph 4 of article 22 of the Trips agreement, the Australian government should establish practical conditions, namely labelling rules, which ensure that "Port Phillip" will be differentiated from "Port" appellation of origin. Portugal will request that this issue will be included in the agenda of the first meeting of the Joint Committee of the agreement, in order to, jointly with Australia, find a solution mutually satisfactory.
