1.I NLEIDING
De laatste vijftig jaar heeft de EU een groot wetgevingscorpus (het acquis) ontwikkeld om tegemoet te komen aan de behoeften van de burgers, de bedrijven en de overheden. Zij heeft de burgers nieuwe rechten gegeven, de markten voor de bedrijven geopend, de publieke belangen versterkt en aldus bijgedragen tot meer groei en welvaart. Wetgeving kan echter ook kosten met zich brengen. De uitdaging is het vinden van het juiste evenwicht ook in de tijd en onder veranderende omstandigheden.
Aan het begin van haar mandaat heeft deze Commissie zich er daarom vast toe verbonden het acquis te herzien om te zorgen voor de relevantie, doeltreffendheid en evenredigheid van de geldende wetgeving

. Te zamen met haar tweelingprogramma voor de vermindering van de

administratieve lasten heeft de strategie voor de vereenvoudiging van de regelgeving een
ambitieus programma vastgesteld voor de actualisering, modernisering en vereenvoudiging van het regelgevingskader van de EU. Vier jaar later kan de Commissie overtuigende resultaten voorleggen. De vereenvoudiging van de regelgeving, die aanvankelijk uit een reeks versnipperde acties bestond, heeft zich ontwikkeld tot een vast bestanddeel van de herziening van het beleid op alle terreinen. De screening van het acquis, waarvan de resultaten tezamen met dit verslag worden gepubliceerd, illustreert duidelijk deze ontwikkeling.
Het derde voortgangsverslag over de strategie voor de vereenvoudiging van de regelgeving vult de derde strategische evaluatie van betere regelgeving in de Europese Unie

en het
werkdocument van de Commissie over de vermindering van de administratieve lasten aan. Het geeft een overzicht van de vooruitgang die sinds de lancering van de strategie is geboekt, belicht de successen daarvan en geeft de gebieden voor toekomstige vereenvoudigingsacties aan.

2.S TAND VAN ZAKEN
Aan de hand van een hele reeks raadplegingsmechanismen is de Commissie voortdurend bezig met de verzameling en analyse van suggesties van burgers, belanghebbenden en lidstaten om de communautaire wetgeving duidelijker, eenvoudiger en doeltreffender te maken.
Op grond van deze input heeft de Commissie een "lopend vereenvoudigingsprogramma" opgesteld dat begint met 100 vereenvoudigingsinitiatieven voor de periode 2005-2008. Het programma maakt gebruik van alle in de vereenvoudigingsstrategie aangegeven instrumenten. Deze omvatten wetgevingstechnieken, met name intrekking, codificatie en herschikking,

alsook andere middelen voor de modernisering van het acquis, zoals een ruimer gebruik van IT-oplossingen.
Sinds 2007 is het vereenvoudigingsprogramma geïntegreerd in het wetgevings- en werkprogramma van de Commissie. Het is elk jaar uitgebreid met nieuwe initiatieven en bestrijkt nu alle beleidsterreinen. Het bevat nu 185 initiatieven en ongeveer 132 van deze initiatieven zijn reeds door de Commissie goedgekeurd, wat betekent dat zowel in 2007 als in 2008 circa 80% van de voorgestelde initiatieven is gerealiseerd. Dit bewijst dat de Commissie vastberaden is om alle obstakels te overwinnen en deze prioritaire acties tijdig tot een goed einde te brengen. Meer dan de helft van deze goedgekeurde initiatieven heeft nu de wetgevingscyclus voltooid en heeft na bekendmaking in het Publicatieblad kracht van wet gekregen.
De Commissie heeft in het kader van het vereenvoudigingsprogramma 2005-2009 reeds ongeveer 800 wetsbesluiten voor wijziging of intrekking voorgesteld. Zodra zij zijn goedgekeurd, zal het acquis worden verminderd met circa 600 wetsbesluiten of circa 6 500 bladzijden van het Publicatieblad. Maar de vereenvoudiging reikt verder. Zij is een bestanddeeel van elke beleidsherziening geworden. Tegelijkertijd is de Commissie ook doorgegaan met de codificatie van het acquis om het compacter en leesbaarder te maken en om voor de nodige rechtszekerheid te zorgen. De Commissie heeft reeds de codificatie van 229 wetsbesluiten afgerond. 142 daarvan zijn reeds door de medewetgever goedgekeurd en hebben 729 bestaande wetsbesluiten vervangen, wat overeenkomt met circa 1 300 bladzijden van het Publicatieblad.
Deze Commissie heeft sinds oktober 2005 actie ondernomen waardoor het acquis met bijna 10% - circa 1 300 wetsbesluiten en 7 800 bladzijden van het Publicatieblad zal worden verminderd.

3.RESULTATEN
Tot nu toe is voor 75 van bovenvermelde 132 vereenvoudigingsinitiatieven het wetgevingsproces afgerond 36 door de Commissie in de vorm van autonome besluiten (bijlage 4) en 39 door de wetgever (bijlage 5).
De voordelen van deze en andere vereenvoudigingsmaatregelen worden steeds tastbaarder voor bedrijven, burgers en overheden. In de volgende punten wordt een aantal voorbeelden gegeven van de verschillende complementaire wijze van aanpak van de vereenvoudiging.
3.1. Een gestroomlijnd regelgevingskader
De wetgeving krijgt geleidelijk vorm naarmate nieuwe bouwstenen aan het juridische bouwwerk worden toegevoegd. Om ervoor te zorgen dat deze bouwstenen goed bij elkaar passen en een coherent kader vormen, houdt de Commissie de bestaande wetgeving voortdurend tegen het licht en zoekt zij naar meer doelmatige en meer doeltreffende wetgevingsoplossingen.
De nieuwe groepsvrijstellingsverordening stelt de lidstaten in staat een reeks
·
steunmaatregelen goed te keuren zonder voorafgaande kennisgeving aan de Commissie, waardoor een aantal zaken sneller kan worden afgehandeld. De verordening, die de bevordering van het creëren van banen en het concurrentievermogen beoogt, heeft
betrekking op verlening van steun aan het mkb, onderzoek, innovatie, regionale ontwikkeling, opleiding, werkgelegenheid en risicokapitaal. Ondernemingen kunnen bijvoorbeeld steun ontvangen voor fundamenteel onderzoek (tot maximaal 100%), industrieel onderzoek (tot maximaal 50/70%) en experimentele ontwikkeling (25/45%). De verordening harmoniseert en consolideert ook vijf wetsbesluiten in één tekst.
· De nieuwe voorschriften betreffende de controles op de directe betalingen aan
landbouwers bieden een eenvoudiger en doeltreffender kader voor de selectie van het controlemonster, het tijdschema van de controles en de procedures voor controles ter plekke

De nieuwe verordening inzake structurele bedrijfsstatistieken vermindert het aantal
·
informatievereisten en voorziet in de verzameling van gegevens op jaarbasis in plaats van op meerjarenbasis. Tegelijkertijd is een nieuwe statistische nomenclatuur van de economische activiteiten in de Europese Gemeenschap ingevoerd. Verwacht wordt dat dit zal leiden tot een nettovermindering van het aantal te verstrekken gegevens met 17,5%.
· In het kader van de thematische strategieën inzake luchtverontreiniging en
afvalpreventie en -recycling is de kaderwetgeving op deze gebieden gestroomlijnd, verduidelijkt en vereenvoudigd. De nieuwe richtlijn inzake luchtkwaliteit voegt vijf afzonderlijke richtlijnen samen en de nieuwe afvalkaderrichtlijn integreert de eerdere afzonderlijke richtlijnen inzake gevaarlijke afvalstoffen en afgewerkte olie. De nieuwe waterkaderrichtlijn biedt één coherent beleidskader voor planning, uitvoering
·
en rapportage om de kwaliteit van schoon water in heel Europa te beschermen en te herstellen, en vermindert het aantal richtlijnen in de watersector van 18 tot 10.
· Een nieuwe richtlijn inzake gezondheid en veiligheid op het werk vereenvoudigt en
rationaliseert de verslagen van de lidstaten over de praktische uitvoering van de kaderrichtlijn en de bijzondere richtlijnen. Voortaan hoeven de lidstaten slechts elke vijf jaar een verslag over te leggen.
3.2. Verbeterde werkmethoden en vereenvoudigde procedures
De Commissie bevordert actief het ruimer gebruik van IT als middel ter verbetering van de werkprocedures.
De nieuwe gemeenschappelijke woordenlijst overheidsopdrachten (een ·
standaardproductbeschrijving van de EU) vergemakkelijkt de identificatie van de mogelijkheden voor overheidsopdrachten in de gehele EU, ongeacht de taal van het land van de overheidsopdracht. De door de overheidsinstanties gebruikte formulieren voor de publicatie van de aankondigingen in het Publicatieblad van de EU zijn gestandaardiseerd en geautomatiseerd, wat de publicatietermijn van 12 tot 5 dagen heeft verkort. Beide ontwikkelingen zullen de transparantie op de markten van overheidsopdrachten vergroten. Elke dag verschijnen op de EU-website "Tenders Electronic Daily" (TED) mogelijkheden voor het doen van zaken in de publieke sector ter waarde van meer dan 1 miljard euro.

De vereenvoudiging van het communautaire douanewetboek omvat de modernisering
·
van de douanewetgeving van de EU en de totstandbrenging van een papierloze omgeving voor de douaneautoriteiten en de handelaren. De elektronische registratie van douaneaangiften en begeleidende documenten zal de regel worden. Erkende handelaren zullen in staat worden gesteld hun goederen elektronisch aan te geven en hun douanerechten te betalen in de lidstaat waar zij zijn gevestigd, ongeacht de plaats waar de goederen zijn binnengebracht in of uitgevoerd uit het douanegebied van de EU of waar zij zullen worden geconsumeerd. Zodra het geïntegreerde systeem volledig operationeel is, zal het voor de handelaren voordelen opleveren die worden geschat op 2,5 miljard euro per jaar. De wijziging van artikel 55 van de algemene verordening inzake het cohesiebeleid heeft
·
de voorschriften voor kleine inkomstengenererende projecten vereenvoudigd. De bepaling betreffende de proportionaliteit voor het toezicht op kleine acties (totale kosten minder dan 200 000 euro) is vervangen door een vrijstelling van de toepassing van het artikel voor door het Europees Sociaal Fonds en het Europees Fonds voor Regionale Ontwikkeling of het Cohesiefonds medegefinancierde acties, wanneer de totale kosten minder dan 1 000 000 euro bedragen.
3.3. Een goed functionerende interne markt
De interne markt is en blijft een drijvende kracht voor de vereenvoudiging in de EU, die het mogelijk maakt dat een hele reeks nationale wetten in een enkele wetstekst worden geconcentreerd.
De gemeenschappelijke regels voor de exploitatie van luchtvervoersdiensten in de
·
Gemeenschap herzien het zogenaamde "derde pakket" voor de liberalisering van het luchtvervoer. Zij moeten leiden tot meer keuze voor de consument, lagere prijzen en meer concurrentie. Strengere voorschriften voor en een beter toezicht op startende luchtvaartmaatschappijen zullen ook het risico van faillissementen en de negatieve gevolgen daarvan voor de passagiers verminderen. De gemiddelde jaarlijkse kosten van faillissementen voor passagiers, inclusief repatriëringskosten en het verlies van reeds betaalde reservaties, worden geschat op 15,6 miljoen euro. Een vermindering met 50% van het aantal faillissementen bij luchtvaartmaatschappijen die maximaal twee jaar actief zijn, zou de consumenten per jaar gemiddeld 2,4 miljoen euro besparen.
· De herziene richtlijn inzake de interoperabiliteit van het spoorwegsysteem in de
Gemeenschap moderniseert de voorschriften voor de certificering van rijtuigen. De besparingen op de certificeringskosten zijn voor de volgende vijftien jaar geschat op 200280 miljoen euro voor de spoorwegmaatschappijen en de producenten.
· De nieuwe verordening inzake maximumresidugehalten (MRL's) voor bestrijdingsmiddelen in levensmiddelen en diervoeders vervangt circa 500 000 nationale MRL's door 100 000 EU-MRL's en helpt de exploitanten, die niet langer meerdere aanvragen in verschillende lidstaten moeten indienen. Het "btw-pakket" voert nieuwe voorschriften voor diensten in, waardoor diensten tussen
·
bedrijven in de lidstaat van de klant zullen worden belast. Dit zou moeten fungeren als een prikkel voor bedrijven om diensten in de gehele Gemeenschap te verlenen. Het pakket omvat ook de oprichting van een kleine "één-loket"-voorziening voor telecom-, omroep- en e-handelsdiensten voor in de EU gevestigde bedrijven en een nieuwe procedure voor
verzoeken om btw-teruggave voor bedrijven die niet zijn gevestigd in de lidstaat waarin de btw is geïnd.
· Op het gebied van het vennootschapsrecht stroomlijnt de in 2007 volgens de versnelde
procedure vastgestelde richtlijn inzake fusies en splitsingen de grensoverschrijdende fusies, wat leidt tot besparingen voor naamloze vennootschappen ten belope van 17 miljoen euro.

4.E R ZIJN NOG MEER RESULTATEN TE VERWACHTEN : IN BEHANDELING ZIJNDE VOORSTELLEN EN INTERINSTITUTIONELE ASPECTEN
Het aantal door de Raad en het Europees Parlement goedgekeurde vereenvoudigingsmaatregelen is gestegen van 16 in januari 2008 tot 39 in januari 2009. Er zijn echter nog 50 vereenvoudigingsvoorstellen in behandeling bij de Raad en het Europese Parlement (bijlage 3). Het is belangrijk dat de instellingen voortgang maken bij de behandeling van deze voorstellen, zodat bedrijven, burgers en overheidsdiensten nog meer voordelen genieten.
· De nieuwe EU-richtlijn inzake beleggingsfondsen, bekend als "UCITS" (instellingen voor
collectieve belegging in effecten), zal de consumenten toegang verschaffen tot professioneel beheerde beleggingen tegen betaalbare voorwaarden; de beheerders van UCITS in staat stellen hun grensoverschrijdende activiteiten te ontwikkelen en te zorgen voor de consolidatie van spaargelden en schaalvoordelen; de beleggers een grotere keuze bieden van tegen lagere kosten opererende beleggingsfondsen; en kleine beleggers beschermen door erop toe te zien dat zij duidelijke, gemakkelijk te begrijpen en relevante informatie ontvangen wanneer zij in UCITS beleggen. De richtlijn zal tien bestaande richtlijnen door een enkele tekst vervangen. Er zijn verscheidene belangrijke voorstellen gedaan op het gebied van het
·
vennootschapsrecht om de uitvoering van bedrijfsactiviteiten in de EU te vereenvoudigen en belangrijke besparingen te doen. Tot deze maatregelen behoren het voorstel voor een verordening van de Raad voor een statuut voor een Europese besloten vennootschap; het voorstel om de vertalings- en publicatievoorschriften voor de ondernemingen te beperken, wat zou leiden tot een geschatte besparing van 600 miljoen euro; en een verder voorstel inzake de verslagleggings- en documentatievoorschriften bij fusies en splitsingen. De nieuwe cosmeticaverordening zal meer dan 3 500 bladzijden wetstekst vervangen. Het
·
voorstel, dat de veiligheidsnormen op hetzelfde hoge niveau handhaaft, zal de kosten voor de bedrijven met ten minste 50% verminderen. De procedures voor de beoordeling van de productveiligheid worden verduidelijkt en de kennisgevingsvoorschriften voor nieuwe cosmetische producten worden vereenvoudigd. Dit zal een significant effect hebben, aangezien de Europese markt voor cosmetische producten circa 65 miljard euro waard is en direct en indirect meer dan 350 000 banen creëert. De herziening van de verordeningen betreffende farmaceutische "wijzigingen" zal de
·
criteria voor de evaluatie van de wijzigingen en de termijnen voor onderzoek en goedkeuring harmoniseren. Uit de gegevens blijkt dat een typische generieke onderneming elk jaar te maken krijgt met meer dan 1 500 veranderingen in verband met geneesmiddelen, terwijl een grotere framaceutische onderneming meer dan 12 000 veranderingen moet verwerken. Het voorstel zal het concurrentievermogen van de ondernemingen versterken door de vermindering van de logistieke problemen, zoals het aanleggen van voorraden van verschillende versies van hetzelfde product voor de
verschillende nationale markten. Het vereenvoudigde kader zal de ondernemingn, met name de kleine en middelgrote ondernemingen, helpen hun activiteiten naar andere EUmarkten uit te breiden. Het nieuwe voorstel voor het "autoveiligheidspakket" zal de bestaande regelgeving
·
vereenvoudigen door de intrekking van 150 richtlijnen over de typegoedkeuring van voertuigen; en de verplichte uitrusting van personenauto's met veiligheidsvoorzieningen en systemen voor bandendrukcontrole invoeren, waardoor de veiligheid van de voertuigen drastisch zal worden verbeterd en de CO
-uitstoot zal worden verminderd.

De richtlijn inzake consumentenrechten zal bijdragen aan het beter functioneren van de
·
interne markt voor "business-to-consumer"-handel door het verminderen van de terughoudendheid van de bedrijven om grensoverschrijdend handel te drijven. Zij zal de versnippering tegengaan en het bestaande regelgevingskader vereenvoudigen door de intrekking van vier richtlijnen. De richtlijn zal het regelgevingskader aanscherpen en een stel standaardvoorwaarden voor consumentencontracten zal de nalevingskosten aanzienlijk verlagen. Het pakket voorstellen op het gebied van energie-efficiëntie beoogt het besparen van
·
energie op sleutelgebieden, bijvoorbeeld door het versterken van de energieefficiëntiewetgeving voor gebouwen en energieverbruikende producten. De gemiddelde jaarlijkse energiebesparing kan gemakkelijk oplopen tot meer dan 1 000 euro per huishouden. Op het gebied van de statistieken inzake de intracommunautaire handel in goederen
·
(Intrastat) zullen de door de Europese wetgeving voorgeschreven rapportagedrempels naar schatting 370 000 ondernemingen van de rapportageverplichting vrijstellen. Dit betekent een vermindering van de ondervraagde populatie met pakweg 52% over een periode van zes jaar (van 720 000 in 2004 tot 350 000 in 2010).
· Het voorstel betreffende het in de handel brengen en het gebruik van diervoeders zal de
innovatie en het concurrentievermogen van de ondernemingen in deze sector vergroten. De nieuwe verordening zal zeven richtlijnen intrekken, waardoor het aantal bladzijden wetstekst van meer dan 100 naar ongeveer 30 zal worden teruggebracht. De zeer strenge vergunningsprocedure voor het in de handel brengen van bepaalde producten (bio-eiwitten) zal ook worden afgeschaft (aangezien zij niet in verhouding staat tot het risico). Om een idee te geven van wat dit betekent in termen van kostenvermindering, zij erop gewezen dat de totale kosten voor een nieuwe bio-eiwitvergunning voor het bedrijfsleven worden geschat op 481 000 euro. Het voorstel voor de herschikking van de richtlijn inzake geïntegreerde preventie en
·
bestrijding van verontreiniging (IPPC) zal zeven richtlijnen betreffende industriële emissies tot één wetgevingsinstrument samenvoegen. Het zal verouderde delen van bestaande richtlijnen schrappen, de vergunningsvoorschriften vereenvoudigen, de rapportageverplichtingen van de exploitanten beperken en de rapportage door de lidstaten stroomlijnen. Het voorstel zal leiden tot significante administratieve kostenbesparingen (naar schatting 32 miljoen euro per jaar) en tot een nog significantere vermindering van de administratieve lasten op het niveau van de lidstaten (nationaal of regionaal) in de orde van grootte van 150 à 300 miljoen euro per jaar.
Het "gsm-pakket" beoogt de openstelling van het 900 en 1800 MHz-spectrum (gsm-
·
banden) voor meer innovatief gebruik. Dit pakket zal de restrictieve regelgeving afschaffen die niet langer de technologische ontwikkeling weerspiegelt en het wijdverbreide gebruik van mobiele breedbanddiensten belemmert. De "gezondheidscheck" van het gemeenschappelijk landbouwbeleid zal leiden tot een
·
vereenvoudiging van de bedrijfstoeslagregeling. In plaats van het behoud van twee parallelle systemen van gekoppelde en ontkoppelde steun zal naar meer ontkoppeling worden gestreefd. Ontkoppeling zal volgens de projecties bijvoorbeeld leiden tot een vermindering van de administratieve lasten van de landbouwers in het VK met 0,63 miljoen euro. De vereenvoudiging schaft ook de 10%-braakleggingseis af. De landbouwers kunnen al hun land gebruiken en hoeven niet langer de bijbehorende procedures te volgen en de lidstaten hoeven deze maatregel niet langer te controleren. Wat de voordelen betreft, wordt verwacht dat dit bijvoorbeeld zal leiden tot een vermindering van de administratieve kosten van de landbouwers in Engeland met 4,4 miljoen euro

· All bepalingen betreffende de controle op de visserij-activiteiten zullen worden
samengebracht in één regelgevend kader, waarbij bijzondere nadruk zal worden gelegd op het uitgebreide gebruik van moderne technologieën en koppelingen met gegevensbanken. De hervorming van het telecompakket zal leiden tot een nettoverlaging van de
·
administratieve kosten voor het bedrijfsleven door het verminderen van het aantal relevante markten die in aanmerking komen voor ex ante-concurrentieregelgeving, het vereenvoudigen van de marktanalyseprocedures, het oprichten van een Europees reguleringsorgaan
en het hervormen van het spectrumbeheer. Elektronische communicatiediensten en -infrastrucuur vormen het fundament van de economie in haar geheel en verbeteringen in deze sector zullen de rest van de EU ten goede komen. Het voorstel tot verbetering van de uitvoering van de regionale-beleidsprogramma's
·
beoogt de vergemakkelijking van het financiële beheer en de versnelling van de vrijmaking van de nodige financiële middelen van de Gemeenschap voor zowel operationele programma's als projecten. De Commissie heeft met name voorgesteld dat de overheadkosten van de projecten op grond van een vast bedrag worden terugbetaald en dat aan de begunstigden betaalde staatsteunvoorschotten door de EU volledig aan de overheidsinstanties kunnen worden terugbetaald. Deze veranderingen zullen van bijzonder nut zijn voor kleine en middelgrote ondernemingen. De modernisering van de coördinatie van de nationale socialezekerheidsregelingen zal
·
het vrije verkeer van werknemers en hun gezinsleden in de gehele EU vergemakkelijken. Zij zal ook ten goede komen aan de 173 miljoen houders van een Europese ziekteverzekeringskaart, die tijdens een tijdelijk verblijf in een lidstaat op dezelfde wijze als de onderdanen van die staat toegang kunnen krijgen tot gezondheidszorg.
Het aantal bij de Raad en het Europees Parlement in behandeling zijnde voorstellen neemt toe. Het is daarom van essentieel belang dat wordt bekeken hoe de goedkeuring daarvan kan worden versneld en dat alles in het werk wordt gesteld om zo mogelijk tijdens de eerste lezing in het medebeslissingsproces tot een akkoord te komen. De Commissie juicht het voornemen van het Europees Parlement toe om specifieke structuren ter aanmoediging van de

vereenvoudiging op te zetten, zoals aangegeven in het onlangs goedgekeurde verslag van de heer Medina Ortega.
Het Europees Parlement heeft zijn wens bevestigd dat de Commissie de herschikking van een wetstekst als gewone wetgevingstechniek gebruikt, ook als een "herziening" van een bestaande tekst wordt voorgesteld. Het is echter belangrijk dat de Raad en het Europees Parlement zich houden aan de beginselen en de geest van de vereenvoudigingsactie door de goedgekeurde voorstellen zo eenvoudig mogelijk te houden en het besluitvormingsproces te versnellen, zodat de bedrijven, de burgers en de overheidsdiensten de voordelen daarvan kunnen genieten.

5.C ODIFICATIE
Naast de vereenvoudiging van de wetgeving codificeert de Commissie ook wetsbesluiten, waarbij zij de basiswet en alle volgende wijzigingen in één tekst samenvoegt. Dit maakt de wetsbesluiten duidelijker en vermindert de omvang van het communautaire acquis.
De Commissie heeft tot nu toe in totaal 229 codificatiebesluiten afgerond. Daarvan zijn 142 besluiten gecodificeerd, goedgekeurd en bekendgemaakt in het Publicatieblad (102 wetsbesluiten van de Commissie en 40 wetsbesluiten van het Europees Parlement en de Raad). Deze 142 gecodificeerde besluiten vervangen 729 bestaande besluiten, wat overeenkomt met circa 1 300 bladzijden van het Publicatieblad.
87 besluiten zijn nog in behandeling bij de Raad en het Europees Parlement.
De grootste achterstand bij de vertaling van de wetgeving voor codificatie in de nieuwe talen is weggewerkt. De resterende voorstellen voor de voltooiing van het codificatieprogramma, dat in 2006 is herzien, zullen in 2009 worden gepresenteerd met een verslag over de verwezenlijkingen van het programma in zijn geheel. Er zijn 21 nieuwe wetsteksten geselecteerd voor codificatie in 2009 (bijlage 6).

6.V OLGENDE STAPPEN 6.1. Initiatieven in de pijplijn voor 2009 6
De Commissie heeft in haar wetgevings- en werkprogramma voor 2009 33 vereenvoudigingsinitiatieven opgenomen (bijlage 7).
Bijvoorbeeld:
herziening van Richtlijn 2000/35/EG betreffende bestrijding van betalingsachterstand

bij handelstransacties die de overheidsinstanties en bedrijven zal ontmoedigen om hun leveranciers te laat te betalen en de crediteuren zal stimuleren om schadevergoeding bij betalingsachterstand te vorderen. Dit initiatief maakt deel uit van de Europese "Small Business Act" en het Europees economisch herstelplan;

wijziging en modernisering van Verordening (EG) nr. 44/2001 om de verordening aan te

passen aan nieuwe internationale instrumenten en om te zorgen voor de erkenning en de tenuitvoerlegging van beslissingen in burgerlijke en handelszaken door de afschaffing van de tussenfasen die burgers moeten doorlopen (exequatur) voor de erkenning en de tenuitvoerlegging van een rechterlijke beslissing in het buitenland;
· hervorming van de gemeenschappelijke organisatie van de markten in de visserij- en
aquacultuursector, met bijzondere aandacht voor duurzame visvangst- en afzetpraktijken. Dit omvat de aanpassing aan de marktontwikkelingen en de versterking van de samenhang met andere elementen van het gemeenschappelijke visserijbeleid en daarmee samenhangende
communautaire beleidsterreinen (handel, gezondheid en consumentenbescherming, milieu) en zal het uitgebreide gebruik van elektronische middelen bevorderen.
Verder blijft de Commissie samen met de lidstaten bekijken hoe de regelgeving inzake het cohesiebeleid kan worden vereenvoudigd en de administratieve lasten voor de begunstigen kunnen worden verminderd.
6.2. Screening van het acquis en toekomstige vereenvoudigingsactiviteiten
Zoals aangekondigd in de tweede strategische evaluatie over betere regelgeving in de Europese Unie heeft de Commissie een omvattende screening van het acquis uitgevoerd.
Als eerste stap is een systematische evaluatie van het acquis verricht om de belangrijkste regelgevingsinstrumenten te identificeren. Als gevolg van deze evaluatie zijn circa 3 600 wetsbesluiten geselecteerd. Deze wetsbesluiten zijn aan een meer gedetailleerde screening onderworpen om na te gaan of zij nog actueel zijn en kunnen worden vereenvoudigd.

De volledige resultaten per beleidsgebied zullen worden gepubliceerd op de Europa-website
over de vereenvoudigingsacties om een duidelijk overzicht te bieden van de tot nu toe door de Commissie geleverde inspanningen op het gebied van de vereenvoudiging.
De uitkomst van de screening laat zien:
· welke vereenvoudiging reeds heeft plaatsgevonden; · welke vereenvoudiging voor 2009 is gepland;
· of er mogelijkheden bestaan voor vereenvoudiging door de volgende Commissie; of
· dat geen vereenvoudiging is gepland, d.w.z. de tekst is duidelijk, actueel en aangepast aan
de beleidsdoelstellingen. In sommige van deze gevallen zouden wijzigingen in de wetgeving voordelen kunnen opleveren, maar deze zouden teniet worden gedaan door de kosten en lasten voor de bedrijven en overheidsdiensten, met name wat de omzetting van de maatregelen betreft.

Er is significante vooruitgang geboekt. Ongeveer twee derde van de wetsbesluiten, die vooral betrekking hebben op landbouw, de interne markt, vervoer, ondernemingen, gezondheid en het milieu, is in het kader van het lopende vereenvoudigingsprogramma, het codificatieprogramma of andere initiatieven van de Commissie vereenvoudigd of is nu opgenomen in de vereenvoudigingsvoorstellen voor 2009 (bijlage 2).
Deze inventarisatie effent het pad voor verdere vereenvoudigingsactiviteiten. Door de bestaande wetsbesluiten in hun sectorale context te onderzoeken streeft de Commissie naar een geïntegreerde aanpak van de vereenvoudiging. 81 nieuwe acties (bijlage 1) zouden in toekomstige vereenvoudigingsinitiatieven kunnen worden opgenomen.
Bijvoorbeeld:
aanpassing van 15 technische harmonisatie-richtlijnen aan het besluit betreffende een
·
gemeenschappelijk kader voor het in de handel brengen van producten. Dit besluit stelt gewoonlijk in de technische harmonisatie-wetgeving gebruikte elementen vast in een gestandaardiseerde vorm die in de toekomstige wetgeving moet worden ingevoerd. Een en ander heeft tot doel te zorgen voor een grotere consistentie van de wetgeving en een gemeenschappelijke "wetgevingscultuur" te creëren. Dit zal de kwaliteit van onze wetgeving verbeteren en de administratieve lasten verminderen; vereenvoudiging van de uitvoeringsvoorschriften voor het gemeenschappelijk
·
landbouwbeleid na de goedkeuring van de "gezondheidscheck" in verband met het mechanisme voor het beheer van de steunverlening;
· herziening van de wetgeving inzake gezondheidsbedreigingen (overdraagbare ziekten en chemische, biologische en radionucleaire bedreigingen) en gezondheid en welzijn van dieren en diervoeders; verdere lastenvermindering op statistisch gebied dankzij het MEETS-programma voor de
·
modernisering van de Europese ondernemings- en handelsstatistieken. Dit zal de methoden voor de verzameling van gegevens in de lidstaten verbeteren door meer gebruik te maken van administratieve en boekhoudkundige gegevens en betere steekproefschema's en ook door een beter en intensiever gebruik van de beschikbare bronnen.

7.S LOTOPMERKINGEN
Sinds de lancering van de strategie voor de vereenvoudiging van de regelgeving in 2005 is de vereenvoudiging een vast bestanddeel van de werkzaamheden van de Commissie geworden. Via een reeks gecoördineerde activiteiten heeft de Commissie een politiek en praktisch actiekader geschapen dat burgers, bedrijven en overheidsdiensten tastbare voordelen biedt. Om de wetgeving duidelijker en begrijpelijker te maken is voorgesteld om circa 1 300 wetsbesluiten, overeenkomend met circa 10% van het acquis, uit het wetgevingscorpus van de EU te schrappen.
Vereenvoudiging is een continu proces. De door de screening van het acquis gemaakte momentopname vormt de aanzet voor de toekomstige werkzaamheden. Een programma dat startte met een beperkt aantal versnipperde initiatieven, bestrijkt nu alle beleidsgebieden en wordt gekenmerkt door een steeds grotere sectorale aanpak. Dat betekent dat het gehele wetgevingscorpus voor een bepaald beleidsgebied wordt onderzocht met het oog op de
identificatie van overlappingen, lacunes, inconsistenties en excessieve regelgevingslasten. Het doel is de algemene doeltreffendheid van het regelgevingskader sector per sector te evalueren.
Voor de uitvoering van de vereenvoudigingsagenda heeft de Commissie de politieke steun van de andere EU-instellingen en de lidstaten nodig. Het Europees Parlement en de Raad wordt verzocht hun uiterste best te doen om de nog in behandeling zijnde voorstellen zo spoedig mogelijk goed te keuren en de vereenvoudigingselementen daarvan tijdens het besluitvormingsproces te handhaven. De lidstaten worden aangemoedigd om hun eigen vereenvoudigingsprogramma's ten uitvoer te leggen en de EU-wetgeving in een geest van vereenvoudiging toe te passen zonder daaraan onnodige maatregelen toe te voegen.
De Europese burgers en bedrijven worden dagelijks geconfronteerd met een mix van EU-, nationale en regionale wetgeving. Alleen een gecoördineerde vereenvoudiginginspanning op al deze niveaus kan ervoor zorgen dat dit regelgevingskader zijn doel op de best mogelijke wijze dient, namelijk het waarborgen van groei en welvaart en het beperken van de lasten tot het strikte minimum.

Notice on the enforcement of State aid law by national courts Revision Review of the 1995 Notice on cooperation between national courts and the Commission in the State aid field. The new Notice will support and assist national courts faced with illegal aid, by setting out the applicable Community Case-law and decisionmaking practice. It will also update and reinforce the support mechanisms offered to national courts. By rationalising and improving existing guidance, the Notice will simplify the tasks of national courts in State aid enforcement.
Best Practices Code in State Aid Revision The Best Practices Code aims at establishing good practices on both the Commission's and Member States' sides with a view to increasing the efficiency, transparency and predictability of State aid procedures. Efficiency could be improved, for instance, by means of improved pre-notification contacts, incentives for more complete notifications by Member States, more standardised information exchange with Member States, as well as streamlined internal procedures. Predictability would be increased by means of quicker decision making. And Member States would obtain more transparency as regards procedural steps and foreseen deadlines. Notice on a simplified procedure in State aid Revision The design of a simplified procedure in State aid aims at ensuring the quick adoption of decisions in straightforward notified aid cases including cases adopted on the basis of the standard assessment section of horizontal state aid instruments, as well as 69

Community initiative on work-related musculoskeletal disorders Recast Follow-up of the second phase of consultation of the social partners. The objective of this initiative is to integrate into a single legislative instrument the provisions on the protection of the health and safety of workers from the risks of musculoskeletal disorders at work. These provisions are currently fragmented over different directives, namely Council Directive 90/269/EEC and Council Directive 90/270/EEC. A single legislative instrument would be more comprehensive, clearer and easier to apply. It will benefit employers in terms of legal clarity and workers in terms of providing better protection against the risks of musculo-skeletal disorders.
Revision of Directive 2000/35 of the European Parliament and Council on combating late payment in commercial transactions Revision Several key provisions of the current Directive are unclear or difficult to implement, thereby creating various hurdles for businesses to claim their rights in case of late payment. The overall objective is to discourage debtors from paying late and to provide creditors with measures that enable them to fully exercise all their rights when paid late. The simplification would entail a clarification of the calculation of the applicable interest rate, a better description of the nature and extent of "retention of title", a new definition of the types of commercial transactions covered by the Directive and a clearer definition of "relevant recovery costs" to include internal administrative costs linked to late payment. 70

Council Regulation on the reform of the common organisation of the markets in fishery and aquaculture products Revision The common market organisation (CMO) was created to achieve the objectives laid down in Article 33 of the Treaty in the fishery sector, in particular to provide market stability and to guarantee a fair income for producers. More recent objectives focus on sustainability-supportive fishing and marketing activities. In place since 1971, the common market organisation has undergone many changes over time, and a reshaped CMO has been in operation since 1 January 2001. The effectiveness and efficiency of this policy is currently being evaluated. The proposal aims at taking account of market developments, changes in fishing activities and the shortcomings detected in the implementation of the provisions currently in force. Commission implementation rules on the reformed control and enforcement framework Revision The new rules will modernize and simplify procedures for national administrations and stakeholders and will facilitate better enforcement. Administrative burden and constraints for the sector and public administrations are to be alleviated, with an increased use of IT tools to reduce reporting obligations. All aspects related to control and monitoring of fisheries activities (declaration of catches, tolerance margins, landing declarations, transport, localisation of the fleet, etc.) will be simplified. Also new elements to address the challenges of Illegal, Unreported and Unregulated (IUU) fishing will be included. Recast of Decisions relating to checks on insurance against civil liability in respect of the use of motor vehicles Recast Over the past few years, the Commission has adopted a number of Decisions (2003/542/EC, 2004/332/EC, 2005/849/EC, and 2007/482/EC) on the abolition of insurance checks in respect of the countries acceding to the EU. The Recast aims at simplifying and clarifying the regime of these Decisions adopted under Article 2 of Directive 72/166/EC on motor insurance.
Recast of the Prospectus Directive Recast Areas where legislative changes are required to improve and simplify the application of the directive will be identified in order to reduce the administrative burden on issuers, without lowering the standard of investors' protection. Among them, the deletion of information requirements that duplicate the transparency directive (Article 10), the extension of the scope of the exemption for employees share schemes (Art. 4.1. e), and the clarification of the responsibilities in case of retail cascade (art. 3.2). This will lead to improved readability and hence enable better and harmonised implementation in MSs thus potentially reducing administrative burdens. Furthermore, other legal provisions, in particular institutional arrangements, such as strengthening of the powers of regulatory bodies and a strengthened cooperation of rail infrastructure managers for international services, will be enhanced to promote the emergence of a genuine internal market and to eliminate barriers to the provisions of international rail transport services. Marine Equipment Directive Recast Directive 96/98/EC has been technically amended three times since its adoption and a further two technical amendments are currently under preparation (respectively concerning the committee procedure and the technical annexes). Furthermore, the new legislative framework for the marketing of products have a direct impact on a number of basic elements (notified bodies, market surveillance, and safeguard clause). Lastly, the current system of periodical technical updates is in need of an indepth revision in order to keep pace with the legislative production of the International Maritime Organisation. It is intended to recast or to repeal the existing Directive and replace it with a new one.
Recast of the Community regulatory framework regarding transport of radioactive material Recast At Community level there are currently more than 30 directives, regulations and recommendations governing the transport of radioactive material. There are also non-binding international rules. Inconsistent transposition of these rules means that there is an unnecessary degree of complexity causing practical problems on the ground in Member States, including increased costs and delays. Simplification of rules and procedures would reduce this and an initial estimate puts the potential at a reduction of 50% in the labour costs and 30% in the costs to operators. (33 initiatives)
