Proposal for a Regulation of the European Parliament and of the Council concerning crop statistics

Delegations will find enclosed a note from the Presidency on the above proposal, with a view to the

Working Party's next meeting on 24 October 2008.

NOTE FROM THE PRESIDENCY

As stated at the Working Party meeting on 3 September 2008, after several working sessions

the Presidency was able to draft a compromise text for the proposal for a Regulation

concerning crop statistics, which has the acceptance of the Commission. The text is annexed to

this note.

The compromise seeks to reconcile the different positions as well as some of the wishes expressed

by Member States at earlier meetings

As regards estimates that are to be transmitted to the Commission:

Table 1

  • A clear distinction between the obligation for all Member States to transmit estimates and the obligation imposed on Member States exceeding certain thresholds;

Elimination of two data transmissions, that of 31 May relating to area under cultivation and

that of 30 June relating to yields. The countries, which under the current agreements are

taking part in the so-called "Early Estimates for Crop Products" (EECP) exercise, will

continue their transmissions; it has been proposed that reference be made to this exercise in a

recital;

  • For the following six winter crops- common wheat, durum wheat, barley, rye, triticale, rape and turnip rape ­ it is proposed to keep 31 January year n as the transmission date for data on

the sown area in countries where production exceeds the thresholds;

  • The transmission of data on area under cultivation on 30 June year n and 31 August year n only applies to countries whose production exceeds the thresholds, countries that are already

taking part in the EECP exercise;

  • The 30 September transmission deadline for area under cultivation, which the Commission regards as essential, is now the main obligation for countries which are below the thresholds;
  • The Presidency is proposing to keep the 31 January n+1 transmission deadline for area under cultivation, even though it is fully aware that the estimate would be more accurate if the date

were pushed back by one or two months, which was the wish expressed by quite a few

Member States, but DG AGRI starts its analyses of the crop year in early February;

  • For harvested production, the existing concept remains unchanged in the compromise text, i.e.; the harvest corresponding to the sown area. However, under exceptional circumstances,

for example in the event of widespread flooding or drought affecting large tracts of land on

which no harvest is possible, the Commission would like the 31 August yield figure

transmitted by the concerned countries (those above the thresholds) to be calculated using the

area under cultivation which would have been harvested had these exceptional events not

occurred;

  • Simplification of several headings entitled "Other ... ";
  • A precision requirement (maximum coefficient of variation) of 3% has been incorporated into the text;
  • Tonnages are indicated in units of basic product weight, accompanied in the case of some headings by moisture content (%).

Table 2

  • Deletion of several aggregates,
  • Setting of a threshold (500 ha and over) for information relating to crops under glass or high (accessible) cover,
  • A single transmission for all Member States for the date of 31 March n+1 instead of the two which had been proposed: 31 March n+1 for MS whose production exceeds thresholds and

one for all MS for 30 September n+1.

  • Deletion of several aggregates,
  • Alignment with Table 2, i.e. a single transmission for all MS on 31 March n+1, except for citrus fruit for which transmission would take place on 30 September n+1,
  • Setting of a threshold (500 ha and above) for information on citrus fruit, vineyards and olive trees,
  • Different categories for vineyards: vineyard for raisin (affects only a few countries), vineyard for table grape, vineyard with protected designation of origin or protected geographical

indication and other wine. Different categories of olive trees, with a distinction being made

between olive trees for table olive and olive trees for olive oil.

Since the Commission has insisted on the necessity for it to have access to , annual figures on land

use, it is proposed to delete several headings and to extend the transitional period to two years,

which would enable a number of Member States to prepare for this.

The compromise text also proposes amendments to the recitals and articles in order to take into

consideration the wishes expressed at previous meetings of the working group and the intentions of

the European Parliament's Rapporteur, which were obtained in informal contacts with the

Presidency. The Presidency is of the opinion that the issue of organic products should not be

addressed in the current text, but suggests instead a new recital providing flexibility for the future in

this regard. It has also been suggested to add a new recital that makes reference to the link between

the current regulation and the "early estimates" (EECP) exercise which Member States are taking

part in on a voluntary basis.

The Presidency is of the opinion that this compromise text, which has simplified the initial proposal

to a large extent, is a balanced and realistic response to a certain number of concerns expressed by

Member States and the Commission and could therefore form the basis for a sound agreement.

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 285(1)

thereof,

Acting in accordance with the procedure laid down in Article 251 of the Treaty , Whereas:

Council Regulation (EEC) No 837/90 of 26 March 1990 concerning statistical information to be

supplied by the Member States on cereals production and Council Regulation (EEC) No 959/93 of 5 April 1993 concerning statistical information to be supplied by Member States on crop products other than cereals

have been amended several times. Since further

amendments and simplifications are now necessary, these acts should, for reasons of clarity, be replaced , in accordance with the Commission's new political approach to the simplification of Community legislation and better regulation.

Statistics on crops are essential for management of the EU markets. It is also considered essential

that vegetable and permanent crop statistics be covered in addition to statistics on cereals and remaining crops from arable land currently governed by legislation.

In order to ensure that the common agricultural policy is properly administered, the Commission

requires that data on areas, yields and production of crops is regulary provided.

Council Regulation (EEC) No 571/88 of 29 February 1988 on the organisation of Community

surveys on the structure of agricultural holdings provides for a programme of Community surveys to provide statistics on the structure of agricultural holdings up to 2007.

In accordance with Regulation (EC) No 1059/2003 of the European Parliament and of the Council

of 26 May 2003 on the establishment of a common classification of territorial units for statistics (NUTS)

, all Member States' statistics transmitted to the Commission which are

broken down by territorial units should use the NUTS classification. Consequently, in order to establish comparable regional statistics, the territorial units should be defined in accordance with the NUTS classification.

In order to limit the burden on Member States, the regional data requirements should not exceed the

requirements under previous legislation (unless new regional levels have appeared in the meantime).

In order to facilitate the implementation of this Regulation, close cooperation is necessary between

the Member States and the Commission, in particular via the Standing Committee for Agricultural Statistics set up by Council Decision 72/279/EEC

In order to ensure a smooth transition from the regime applicable under Council Regulations (EEC)

No 837/90 and (EEC) No 959/93, this Regulation should allow for a transitional period of up to

[...] two years, to be granted to Member States where the application of this Regulation

to their national statistical systems would require major adaptations and would be likely to cause significant practical problems.

Since the objective of the proposed action, namely the establishment of a common legal framework

for the systematic production of Community statistics on areas under cultivation, yields and production of cereals and crops other than cereals in Member States, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level, the Community may take action in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. In accordance with the principle of proportionality, as set out in the same Article, this Regulation does not go beyond what is necessary to achieve its objective.

the reference framework for the provisions of this Regulation [...] in particular [...] as regards conformity to standards of impartiality, reliability [...] relevance, cost-effectiveness, statistical confidentiality and transparency. Council Regulation (Euratom, EEC) o

1588/90 of 11 June 1990 on the transmission of data subject to statistical confidentiality to the Statistical Office of the European Communities constitutes a reference framework for the transmission and protection of confidential statistical data provided for under this Regulation, in order to ensure that no unlawful disclosure and non-statistical use take place when Community statistics are produced and disseminated.

The measures necessary for implementation of this Regulation should be adopted in accordance

with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission

In particular, [...] the Commission should be empowered to modify [...] the transmission tables Since such measures are of general scope and are [...] designed to amend non-essential elements of this Regulation [...], inter alia by supplementing it with new non-essential elements, they must be adopted in accordance with the regulatory procedure with scrutiny provided for in Article 5a of Decision 1999/468/EC.

The Standing Committee for Agricultural Statistics has been consulted,

Member States shall transmit to the Commission the statistical information necessary for the

implementation and follow-up of the Regulation(EC) o 834/2007 on organic production and labelling of organic products. Concerning organic crop production, Commission could present, if necessary, further proposals to amend the present regulation.

The objective of the present Regulation is linked with statistics of the Early Estimates of Crop

Products applied on voluntary basis by Member States.

HAVE ADOPTED THIS REGULATION:

Article 1

Subject matter

This Regulation establishes a common framework for the systematic production of Community statistics on land use and crop production.

Article 2

Definitions

  • 1. 
    For the purpose of this Regulation, the following definitions shall apply:
  • a) 
    'harvest year' is the calendar year in which the harvest begins;
  • b) 
    'utilised agricultural area' is the area as defined in Council Regulation (EEC) No 571/88.
  • c) 
    'area under cultivation' is until the harvest, the area under cultivation corresponds to sown

area excluding ruined area (e.g. natural disasters); after the harvest, the area under cultivation

corresponds to the harvested area;

  • d) 
    'cropped area' correspond to the total sown area for producing a specific crop during the same

year;

  • e) 
    'harvested area' [...] means the part of the cropped area that is harvested. It can, therefore, be

equal to or less than the cropped area;

    'production area" for the purposes of permanent crops [...]means the area that potentially can

be harvested in the reference harvest year. It excludes all the non-producing areas, such as new

plantations that have not yet started to produce;

  • g) 
    'harvested production' includes on-holding losses and wastage, quantities consumed directly

on the farm and marketed quantities, indicated in units of basic product weight. [...]

  • h) 
    'yield' [...]means the harvested production per area under cultivation;
  • i) 
    'successive cropping'[...] means a parcel of arable land that is used more than once during a given crop year and the area each time has only one crop. Both areas shall be considered as area under cultivation for each crop (the concepts of main and secondary areas are not applicable in this context); j) 'combined cropping'[...] means a combination of crops that occupy a parcel of agricultural

area at the same time. The area under cultivation in this case is distributed between the crop

products proportionately to the area of ground they occupy (the concepts of main and secondary

areas are not applicable in this context);

  • k) 
    'dual-purpose crops' are by convention considered for their primary use and as secondary

crops for their supplementary use.

  • l) 
    'crops under glass or high (accessible) cover' [...]means crops which, for the whole of their

period of growth or for the predominant part of it, are covered by greenhouses or fixed or mobile

high cover (glass or rigid or flexible plastic). This excludes sheets of plastic laid flat on the

ground, as well as land under cloches or tunnels not accessible to man or movable glass-covered

frames. Areas of crops which are grown temporarily under glass and temporarily in the open air

are reported as entirely under glass, unless the period under glass is of extremely limited

duration.

  • m) 
    'main area'[...]of a given parcel is, in the general case, where the parcel has only one

occupation during a crop year, unequivocally defined by that occupation [...].

  • 2.

Coverage

  • 1. 
    Member States shall produce statistics on the crops listed in the Annex [...] produced on the utilised agricultural area within their territory.
  • 2. 
    Statistics shall be representative of at least 95% of the following areas [...] : a) total area under cultivation of crops from arable land (Table 1);

22.7.2006, p. 1).

  • b) 
    total harvested area of vegetables, melons and strawberries (Table 2);
  • c) 
    total production area of permanent crops (Table 3);
  • d) 
    utilised agricultural area (Table 4).
  • 3. 
    Variables with a low or zero prevalence in a Member State may be excluded from the statistics,

provided the Member State informs the Commission of all such crops in the calendar year

immediately preceding each of the reference periods. Member States shall inform the Commission

on their definition of low prevalence when data are provided.

Article 4

Frequency and reference period

Member States shall provide annually to the Commission the data referred to in Annex [...] . The reference period shall be the harvest year. The first reference year shall be 2010.

Article 5

Precision

Member States conducting sample surveys in order to obtain statistics shall take the necessary

steps to ensure that table 1 data meet the following precision requirements [...] : the coefficient of variation of the data to be provided by 30 September of the year n+1 shall not exceed (at national

level) 3% for the area under cultivation for each of the following groups of main crops: cereals

for the production of grain (including seed), dried pulses and protein crops for the production of

grain (including seed mixtures of cereals and pulses), root crops, industrial crops and plant

harvested green.

In regard to sources other than surveys in order to obtain statistics, Member States shall ensure this

information is [...] at least of equal quality [...] compared to information obtained from statistical surveys.

In case of use of administrative sources, Member States shall inform the Commission in advance about methods used and the quality of data.

Article 6

Member States shall transmit to the Commission (Eurostat) the data set out in Annex II within the time limits specified for each table.

The transmission tables as set out in the Annex [...] may be adapted by the Commission [...] . These measures designed to amend non-essential elements of this Regulation, inter alia, by

supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny

referred to in Article 9 [...] (2).

Article 7

Regional statistics

  • 1. 
    The data marked with "R" in Annex II shall be provided by the NUTS 1 and NUTS 2 territorial units defined in Regulation (EC) No 1059/2003. By exception, they may be provided by NUTS 1 territorial units only for Germany and the United Kingdom. 2. Variables with a low or zero prevalence may be excluded from the regional statistics, provided the Member State informs the Commission of all such crops in the calendar year immediately preceding each of the reference periods. Member States shall inform the Commission on their definition of low prevalence when data are provided.

Article 8

Quality assessment and report

  • 1. 
    For the purpose of this Regulation, the following quality assessment dimensions shall apply to the data to be transmitted: (a) 'relevance' refers to the degree to which statistics meet current and potential needs of users; (b) 'accuracy' refers to the closeness of estimates to the unknown true values;

(c) 'timeliness' refers to the time lag between the availability of the information and the event or phenomenon it describes;

(d) 'punctuality' refers to the time lag between the date of release of the data and the target date when it should have been delivered; (e) 'accessibility' and 'clarity' refer to the conditions and modalities by which users can obtain, use and interpret data;

(f) 'comparability' refers to the measurement of the impact of differences in applied statistical concepts and measurement tools and procedures when statistics are compared between geographical areas, sectoral domains or over time; (g) 'coherence' refers to the adequacy of the data to be reliably combined in different ways and for various uses.

  • 2. 
    Every three years, and for the first time [...] twenty-one months after the date of application

of this Regulation , Member States shall provide the Commission (Eurostat) with a report on the quality of the data transmitted making reference to the quality assessment dimensions summed-up in paragraph 1 of this article.

  • 3. 
    In applying the quality dimensions laid down in paragraph 1 of this article to the data covered by this Regulation, the modalities and the structure of the quality reports shall be defined in accordance with the procedures referred to in Article 9(2). 4. Member States shall inform the Commission of any methodological or other change which would considerably influence the quality of the statistics, not later than three months after this change is effected. 5. Committee procedure

  • 1. 
    The Commission shall be assisted by the Standing Committee for Agricultural Statistics established by Article 1 of Council Decision 72/279/EEC.

    [...] Where reference is made to this paragraph, Article 5a (1) to (4) and Article 7 of Decision 1999/468/EC shall apply, having regard to the provisions of Article 8 thereof.

Article 10

Transitional period

  • 1. 
    Full calendar year transitional periods for implementation of this Regulation ending no later than

[...] two year after the date from which it applies may be granted to Member States, in so far as the application of this Regulation to their national statistical systems requires major adaptations and is

likely to cause significant practical problems, in accordance with the regulatory procedure with

scrutiny laid down in Article 9(2).

  • 2. 
    To this end, a Member State shall present a duly justified request to the Commission not later

than three months after the entry into force of this Regulation.

Article 11

Repeal

  • 1. 
    Without prejudice to paragraph 3, Council Regulations (EEC) No 837/90 and (EEC) No 959/93 are hereby repealed as from 1 January 2010.
  • 2. 
    References made to the repealed Regulations shall be construed as being made to this Regulation.
  • 3. 
    By way of derogation from Article 12 (2), a Member State having been granted a derogation in

accordance with Article 10 shall continue to apply the provisions of Council Regulations (EEC) No

837/90 and (EEC) No 959/93 for the duration of the transitional period granted.

Article 12

Entry into force

  • 1. 
    This Regulation shall enter into force on the twentieth day following that of its publication in the

Official Journal of the European Union.

  • 2. 
    It shall apply from 1 January 2010.
  • 3. 
    This Regulation shall be binding in its entirety and directly applicable in all Member States.
