The outcome of this examination is summarised below. Article 27: Establishment of the Catalogue and the Codes Several delegations (DE, ES, NL, SE) requested clarification of the procedure used to draw up the Catalogue and the Codes. voluntary nature of the list, such as the consequences of not including a feed material in the Catalogue or questions on the control of feed materials that are not present in the Catalogue. Article 28: Amendments to Annexes and implementing measures Delegations did not have any comments on this article. Article 29: Committee procedure The Commission representative proposed including a new paragraph in this article establishing an urgency procedure. At this stage, delegations did not have any comments on this Article. Article 30: Amendment to Regulation (EC) No 1831/2003 While expressing their support for this article, some delegations (BE, ES, SE, SI) requested clarification of its content. A number of delegations (AT, BE, DK, FI, FR, NL, SE and SI, in particular) emphasised the need to explain that products intended for export to third countries are not included in the scope of this Regulation. The Commission representative had a positive view on this comment. Article 6 of Regulation 178/2002. the market" with " business responsible for the labelling" in paragraph 1(a). Article 32: Penalties Some delegations (AT, IT, NL, PT, UK) supported the Commission's suggestion to delete the word "financial" before "penalties" in order to leave Member States the choice on the nature of the penalties applicable for infringements of this Regulation. Article 33: Transitional measures Some delegations (AT, BE, DE, IT, UK) requested clarification on the transitional period for labels issued on the basis of current rules. Article 34: Entry into force Delegations did not have any comments on this article. Annex I Three delegations (BE, DK, UK) requested clarification on the concept of "processing aids" in paragraph 1. Some delegations (FR, IE, UK) queried the 14% figure in paragraph 6, asking for further clarification on this point. One delegation (ES) questioned the reference to the Catalogue as a regulatory tool in paragraphs 1 and 2. Another delegation (FR) suggested considering the wording used by Directive 96/25 on this item. Two delegations (DE, SK) requested to clarify that, in addition to binding materials, the 3% limit in paragraph 4 applies to denaturing materials as well, while certain delegations (BE, CZ, DE, ES, FI, IE, NL, and UK, in particular) emphasised the need to maintain derogation for liquid feed. to" (UK). Annex II A number of delegations (DE, DK, ES, FI, IT, PT, in particular) suggested removing the words "per kg" in paragraph 1. Several delegations (ES, FI, CZ) raised issues related to the synonymic expressions in certain languages in paragraph 4. Some delegations (DK, ES, FI, IT, PT) suggested modifying paragraph 5 as follows: "...shall either state the maximum quantity in grams or kilograms of complementary feed per animal per day or shall state the inclusion rate of the complementary feed in the complete feed". A number of delegations (AT, DE, PT, SE) also supported deleting paragraph 6. One delegation (HU) expressed concerns over the indication of the date in point 3, as this might cause confusion in this particular Member State due to local specificities. Annex III While, in general, delegations expressed support for the Commission's attempt to achieve simplification, they emphasised that there are points that need improvement in the current version. They also stated that the most appropriate forum to deal with questions raised by Annex III is an expert group through the comitology procedure. Two delegations (DE and DK) submitted proposals for modifying Annex III. A number of delegations (BE, CZ, DE, ES, FI, FR, IE, NL, PT, and UK, in particular) supported the Commission's proposal to consider the current Annex III as a good starting point for further work by a group of experts and amend Article 28 accordingly. At the same time, the Commission will commit to adopt in reasonable time the necessary modifications through the comitology procedure. RI/prk 4 DG B II LIMITE EN
The following specific drafting suggestions have been made: - clarify that the 3.5% figure refers to dry matter (DE, ES, PT, SE, UK, in particular); - include in points 12 and 13 the mention "...other than those mentioned at points..." (DK, UK). Annex V While analysing Chapter I of this Annex, delegations discussed the need to indicate additives on the label, with some delegations (DK, SE, SI, SK, in particular) requesting to include the total amount of additives with a maximum content , while other delegations (AT, BE, FR, NL) expressed doubts over this suggestion. Several delegations (BE, DE, DK) suggested replacing "functional group" with "category" in paragraph 1. Two delegations (DK, ES) also questioned the need to keep the reference to Article 22 (2) in the heading of the Annex. One delegation (FI) stressed that, while Chapter I should focus on "added" amount of additives, Chapter II should refer to "total" amount present. Three delegations (DK, ES, SE) also supported including labelling for Calcium, Phosphorus and Sodium. Delegations also stressed the need to refer to the energy value. Annex VI The Commission representative mentioned that this Annex is similar to Annex V, except for paragraph 3. Therefore, accepted comments for Annex V will be included in Annex VI as well. Two delegations (DK, FI) requested including fur animals in the scope of this Annex. At the same time, it has been requested to add a footnote to Chapter II of this Annex linked to "energy value".
