I.

Introduction

On 2 February 2007 the Permanent Representatives Committee took note of the state of play

of proposals included in the Commission's simplification programme (doc. 5759/07). It was

agreed that the Committee would be regularly updated on progress on simplification

proposals, by means of surveys produced by the Council Secretariat on the basis of

information by the Commission and the chairpersons of the relevant working parties.

The Spring 2007 European Council encouraged the Commission to present proposals

corresponding to the 10 fast track actions set out in the Action Programme for reducing

administrative burdens and called on the Council and the European Parliament to give special

priority to these measures with a view to their adoption as soon as possible in 2007. At

present, two "fast-track proposals" are under discussions in the Council bodies and in the

Parliament. One relates to company law issues and the other one to transport and food

hygiene.

II. Simplification: state of play

Delegations will find in the Annex a table showing the state of play of simplification

proposals as of 15 June 2007.

III. Reduction of administrative burdens: fast-track proposals

  • a) 
    Company Law:

On 9 March 2007 the Commission submitted to the Council a proposal for a Directive of the European Parliament and of the Council amending Council Directive 78/855/EEC

concerning mergers of public limited liability companies and Council Directive 82/891/EEC

concerning the division of public limited companies as regards the requirement for an

independent expert's report on the occasion of a merger or a division (doc. 7207/07).

On 16 May 2007 the Company Law attachés widely supported a compromise text that was subsequently taken up by the EP Rapporteur, Mrs Kauppi, in her draft Report and is expected

to be endorsed by the JURI Committee. A further request of the EP to insert a reference in

Recital 4 of the proposal to the right of information of employees of the companies under

merger or division has been accepted by the Presidency and will be introduced to the text,

subject to acceptance by delegations.

The Presidency intends to submit this compromise package to the Committee of Permanent Representatives of 20 June 2007 for discussion (as a II point) and possible agreement. Should

agreement be reached at the Committee of Permanent Representatives, the JURI Committee

could vote on the compromise package on 26 June 2007, with a view to adoption of the

Parliament's Opinion in the 9-12 July 2007 plenary session .

  • b) 
    Transport and food hygiene:

On 7 March 2007, the Commission submitted to the Council a proposal for a Regulation of

the European Parliament and of the Council amending Regulation No 11 concerning the

abolition of discrimination in transport rates and conditions, in implementation of Article

79(3) of the Treaty establishing the European Economic Community and Regulation (EC) No

852/2004 of the European Parliament and the Council on the hygiene of foodstuffs (Article 2)

(doc. 7371/07).

Following the mandate from the Permanent Representatives Committee of 21 March 2007,

two working parties examined the proposal: the Working Party on Land Transport and the

Working Party of Veterinary Experts (Public Health).

On 20 and 23 April 2007 the Working Party on Land Transport examined Article 1 (only article relevant to transport experts). Member States supported in general the proposal. EL

entered a scrutiny reservation. UK entered a parliamentary scrutiny reservation. FR indicated

a discrepancy in FR version in Art. 1(2)(b) and asked for a coherent reference to Article 75(1)

of the Treaty in Art. 1(2)(c). The Commission will inform the Chair of the Competitiveness

and Growth Working Party accordingly, so that these problems are corrected in a new version

of the text.

The Working Party of Veterinary Experts (Public Health) carried out an examination of

Article 2 (only article relevant for the veterinary experts) on 13 April 2007 and 21 May 2007.

It also examined a compromise document from the Presidency based on risk analysis criteria,

aiming at responding to the concerns previously raised by the Member States.

A great number of Member States held on to their concerns or maintained their opposition to 1

amendments of article 5 of Regulation (EC) 852/2004. In this context it was discussed 2

whether Regulation (EC) No 852/2004 and the Commission's guidance document provide sufficient flexibility for small food businesses.

IV. Conclusion

The Committee is invited to take note of the information provided in this note.
