I. INTRODUCTION

At its meeting on 11 December 2006, the Working Party on Agricultural Questions

(Pesticides/Plant Protection Products) continued its examination of the above proposal.

II. MAIN ITEMS OF DISCUSSION

Articles 36-43 were examined. The discussion focused, in particular, on the following issues:

Certain delegations have indicated that they are still reflecting on certain aspects of the proposal. DE, DK, MT and UK maintain a Parliamentary Scrutiny Reservation at this stage.

  • A) 
    Timelines

A number of delegations called for the timelines to be fine-tuned. Several delegations called

for more time to be provided for the Member States to complete the tasks assigned to them in

the new procedure. Some delegations saw merit in setting specific deadlines for all aspects of

the procedure whilst others called for flexibility.

  • B) 
    Mutual Recognition

A large majority of delegations welcomed the idea of mutual recognition in principle,

although many delegations considered that the suggested provisions required further work.

Numerous delegations emphasised the need to take national conditions into account,

particularly in regard to the environment. A number of delegations stressed the importance of

facilitating mutual recognition beyond the proposed zones as appropriate, and between

neighbouring countries, in particular.

  • C) 
    Assessment of Equivalence

Several delegations considered that the provisions proposed for the assessment of equivalence

required further discussion, some expressing the view that equivalence should be a

precondition for authorisation.

The Commission representative offered a number of explanations and clarifications and

undertook to reflect on some of the suggestions made.

Further details are set out in the Appendix to this report.

III. CONCLUSION

The Finnish Presidency reminded delegations that Council would be informed of the progress

achieved on this file. The Working Party took note of provisional information regarding the work programme of the forthcoming German Presidency in this sector.
