Het algemene beleid van de Unie op dit gebied is krachtens artikel 67 van het Verdrag betreffende de werking van de Europese Unie gericht op de totstandbrenging van een hoge mate van veiligheid via maatregelen voor de preventie en bestrijding van criminaliteit, waaronder seksueel misbruik en seksuele uitbuiting van kinderen. Overeenkomstig artikel 83 van het Verdrag betreffende de werking van de Europese Unie moeten hiertoe in de eerste plaats minimumvoorschriften worden vastgesteld betreffende de bepaling van strafbare feiten en sancties op het gebied van de seksuele uitbuiting van kinderen. Concrete doelstellingen zijn onder meer een doeltreffende vervolging van het misdrijf, bescherming van de rechten van de slachtoffers en de preventie van seksuele uitbuiting en seksueel misbruik van kinderen.

Deze Richtlijn is gebaseerd op Verdrag betreffende de werking van de Europese Unie artikel 82 lid 2 en artikel 83 lid 1.
